Dear Sir or Madam:

Luminant Generation Company LLC (Luminant Power) requested relief from ASME OM Code 1998 Edition, through 2000 Addenda, for the testing of the Safeguards Building Sump Pumps (SBSPs) at Comanche Peak Nuclear Power Plant (CPNPP) via Reference 1 pursuant to 10 CFR 50.55a(3)(i).

Reference 2 granted relief on an interim period of up to two refueling cycles but not to exceed 4 years.

This interim relief will end in September 2009.

Luminant Power has provided the information requested per Reference 3 in the Attachment to this letter.

NRC QUESTION The RR states a test can be performed that demonstrates the SBSP can meet its intended safety functions. Please provide a copy of the test procedure that will be used, including acceptance criteria to be utilized, to determine acceptable pump performance.

LUMINANT POWER RESPONSE Procedures OPT-518A/B, "Safeguards Building Sump Pumps and Check Valve Test" are enclosed. Acceptance criteria are included in the procedures.

2. NRC QUESTION The RR states the SBSP test will require pumping the same quantity of fluid along a repeatable system path, while measuring flow and vibration. Please describe how the flow rate is measured or determined. Also, discuss any system parameters associated with the flow path that will affect the results of the test and how those parameters will be controlled such that repeatability is achieved.

LUMINANT POWER RESPONSE The flow rate is measured using an ultrasonic portable flow measurement instrument.

This instrument straps on the outside of the SBSP discharge pipe. System configuration is established in OPT-518A/B assuring that a repeatable system flow path will be utilized each time.

The factors that could potentially affect the repeatability of the test are:

a. any changes in system resistance, and
b. degradation in the in-line check valve.

These factors are addressed as discussed below:

a. The system resistance changes can be due to different valve line-ups, throttling of flow, or additional flow sources. This is being addressed by ensuring that the valve line-ups are verified and other sump pumps are

.turned off during the performance of the test using procedure OPT-518A/B "Safeguards Building Sump Pumps and Check Valve Test."

b. Degradation in the pump discharge check valve could result in a change in flowrate and affect the repeatability of the test. However, this specific test and flow path are also used to perform open and closed tests of the pump discharge check valves. Therefore, failure to meet the flow requirement or trends of degradation in flow will result in evaluating or repairing the pumps and discharge check valves.
3. NRC QUESTION The RR states the required SBSP head to pump to the Waste Holdup Tank is greater than the required head to discharge to the Floor Drain Tank, which is the normal lineup. Please discuss the safety-related lineup of the sump pumps and how the discharge head required during testing and normal operation differs from the discharge head required during emergency conditions.

LUMINANT POWER RESPONSE The design flow for the SBSPs is 50 gpm at no specific head requirement. The' SBSPs are designed with a capacity of 50 gpm due to a flange or mechanical seal passive failure to the ECCS pumps. The SBSPs are designed to deliver to both the waste holdup tank and the floor drain tank. The normal lineup is also the same as the emergency line-up which is discharging to the floor drain tank. However, it is permissible to be aligned to the waste holdup tank during normal operations and realignment is not required during an accident. The path to the waste holdup tank (which is our proposed test path) has a greater system resistance due to the piping configuration. Therefore, testing to the waste holdup tank is a more stringent test to verify the design flowrate of 50 gpm.

5.1.2 The sump is a potentially contaminated area.

5.2 Limitations None 5.3 Notes 5.3.1 This procedure can be used to satisfy Post Work Testing requirements as long as applicable Precautions, Limitations and Prerequisites are satisfied. IF any section is NOT performed in its entirety, THEN fill in the appropriate spaces on the data sheet and N/A all spaces NOT performed.

5.3.2 Approximately 30 feet of hose will be required for this test (sump fill options are available).

5.3.3 Filling the sumps can cause water to backup and possibly overflow from floor drains. The sump Hi-Hi level alarm should be approached carefully to avoid overfilling the sumps.

Previous test performance observations have indicated that the Hi-Hi level alarm actuates at approximately one (1") inch below the grating in the floor drains.

5.3.4 On September 27, 2006, the NRC granted interim relief for testing the Safeguard Building Sump Pumps. The interim relief is granted for up to two cycles on each Unit and no more than four years. The purpose of this relief is for CPSES to determine a final solution to this problem. Refer to EVAL-2006-002428-01

LI 6.2 Notify Maintenance to install a portable flowmeter on at least a 5 foot run of pipe near 1VD-0900.

(located 790' elev., Rm X-179). IF a Panametrics Flow instrument is used, THEN inform Maintenance that previous test performance has indicated that using the "STATISTICS" mode provides a more rapid collection of data.

5.1.2 The sump is a potentially contaminated area.

5.2 Limitations None 5.3 Notes 5.3.1 This procedure can be used to satisfy Post Work Testing requirements as long as applicable Precautions, Limitations and Prerequisites are satisfied. 5.3.2 Approximately 30 feet of hose will be required for this'test (sump fill options are available).

5.3.3 Filling the sumps can cause water to backup and possibly overflow from floor drains. The sump Hi-Hi level alarm should be approached carefully to avoid overfilling the sumps.

Previous test performance observations have indicated that the Hi-Hi level alarm actuates at approximately one (1") inch below the grating in the floor drains.

5.3.4 On September 27, 2006, the NRC granted interim relief for testing the Safeguard Building Sump Pumps. The interim relief is granted for up to two cycles on each Unit and no more than four years. The purpose of this relief is for CPSES to determine a final solution to this problem. Refer to EVAL-2006-002428-01.

IF a Panametrics Flow instrument is used, THEN inform Maintenance that previous test performance has indicated that using the "STATISTICS" mode provides a more rapid collection of data.
