Dear Sir:

In accordance with 10 CFR 50.83(b), Duke Energy Florida, LLC (DEF), submitted a request for approval to remove a portion of the site from the Crystal River Nuclear Plant (CR3) Part 50 license (License No. DPR-72) (Reference 1). Specifically, DEF requested approval to remove the non-impacted survey units from its Part 50 license in accordance with 10 CFR 50.83(b), "Release of part of a power reactor facility or site for unrestricted use".

Attachment 3 to the above-mentioned submittal included a computer disk (CD) containing the non-NRC references. On this CD, documents six (6) through thirteen (13) consist of proprietary information that is considered confidential.

Attachment 1, of this letter, is an affidavit which contains the basis for the proprietary requirement of those documents.

This correspondence contains no new regulatory commitments.
