Title | Permanent Modification to Valve 1N122XSI0010A and Eight Others Without Prior NRC Approval |
Description | The inspectors identified a Severity Level IV non-cited violation of 10 CFR 50.59, Changes, Tests, and Experiments, for the failure to obtain NRC authorization for the installation of seal cap enclosures on nine charging and volume control and safety injection valves in Units 1 and 2. The licensee implemented modifications on each of the valves to control body-to-bonnet gasket leakage. The modification did not shift the pressure retaining boundary of the affected systems and components, and as a result prevented the inspections required by American Society of Mechanical Engineers Boiler and Pressure Vessel Code. Title 10 CFR 50.59 states that prior NRC approval is required for changes resulting in more than a minimal increase in the likelihood of occurrence of a malfunction of a system, structure, or component important to safety previously evaluated in the Final Safety Analysis Report (as updated). The finding was more than minor because it affected the Mitigating Systems Cornerstone attribute of Equipment Performance and affected the cornerstone objective to ensure the reliability and capability of safety injection to respond to an initiating event. The issue was determined to result in more than a minimal increase in the likelihood of occurrence of a malfunction of a structure, system, or component important to safety previously evaluated in the Updated Final Safety Analysis Report. In accordance with the NRC Enforcement Manual, violations of 10 CFR 50.59 are not processed directly through the significance determination process; as a result, this issue was determined to be applicable to traditional enforcement. A Significance Determination Process screening was performed and the finding was determined to have very low safety significance (Green) because there was no actual loss of the mitigating system safety function. Because the performance deficiency was determined to be of very low safety significance, this finding is considered a Severity Level IV violation in traditional enforcement. Based on discussions with the Office of Nuclear Reactor Regulation staff, the inspectors determined that a request for approval would likely have been granted.
