Wastewater Permit PL0002208 Plorida Power & Light St.'Lucie Power Plant

Dear Mr. Stall:

The Department has received your letter and application dated February 25, 1999 requesting a minor revision of%astewater Permit PL0002208 to allow replacement of the existing demineralizer system at the St. Lucio Power Plant. The Department has determined that tliis replacement of the existing demineralizer system constitutes a minor modification of the St. Lucie Power Plant operations pursuant to rule 62-620.200(23),

F.A.C., and can be authorized by a minor permit revision pursuant to rule 62-620.325(2),

P.A.C.

The Department hereby approves this request and this letter constitutes a minor revision to your Wastewater Permit authorizing the installation and operation of the proposed water softener/reverse osmosis treatment system as described in the application.

This authorization is subject to the following conditions:

1) The St. Lucie facility willnotify the Tallahassee office, i'n. writing, at commencement of treatment system installation and operation via submittal of DBP form 62-620.910(12).
2) Alldischarges from this water treatment system willbe directed to the existing low volume waste pond. Based on the results of the sampling required in condition 3. below, the Department may allow alternative disposaVreuse of these wastestreams.

3) Within 30 days from the start of full operation of the treatment system, the facility willsample and analyze each discharge stream from the treatment system 'for the following parameters:

a) Total Suspended Solids b) Total Dissolved Solids c) pH d) Sodium e) Chlorides Samples shall be taken prior to mixing with any other waste st'reams.'. Analytical results shall be submitted to the Department within 30 days from'he sample collection date. The Department reserves the right to require a'dditional monitoring at the facility

1. SYNOPSIS OF APPLICATION A. Name and Address of Applicant Florida Power Ec Light Company 6501 S. Ocean Drive Jensen Beach, Florida 34957 For:

St. Lucie Power Plant Units 1 and 2 Hutchinson Island St. Lucie County, Florida B. Description Minor Revision The minor revision authorizes a modification involving replacement of the facility demineralizer portion of the make-up system with a water softener/reverse osmosis treatment system followed by demineralizer polishing. The facility willeventually eliminate the discharge of outfall OSN 002 when the system is fully operational.

Minor Revision Justification The following documentation provides reasonable assurance of minimal exposure to the environment from the discharge of process wastewater to groundwater s:

(1) Support documentation submitted w'ith the minor revision request states the proposed system willbe fed from the plant's City Water Storage Tanks, which are supplied by Ft. Pierce Utilities.

(2) The Florida Power 2 Light St. Lucie Power Plant Wastewater Permit Application, dated April 1996, Item IIIAAttachment, states a study provided by Technos Inc. (1984) indicated the following:

i) The site is isolated hydrologically from any off-site "fresh" water by the natural saltwater bodies and the intake and discharge canals; ii) The St. Lucie Plant site is completely underlain by intruding saltwater at shallow depths; iii) Any discharge to groundwater from the unlined basins on the plant "island" is intercepted by the intake canal and discharged to the Atlantic Ocean.

D. FDEP CONTACT Additional information concerning the minor permit revision may be obtained by Wanda Parker-Garvin at FDEP, Blair Stone Road, Tallahassee, Florida 32399-2400 between the hours of 8 A.M. and 5 P.M., Monday through Friday.

Notice of Rights A person whose substantial interests are affected by the Department's proposed decision may petition for an administrative proceeding (hearing) under sections 120.569 and 120.57 of the Florida Statutes. The petition must contain the information set forth below and must be filed (received by the clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000.

Petitions by the applicant or any of the parties listed below must be filed within twenty-one days of receipt of this written notice. Petitions filed by any persons other than those entitled to NTitten notice under section 120.60(3) of the Florida Statutes must be filed within twenty-one days of publication of the notice or within twenty-one days of recei P t of the written notice, whichever occurs first.

Under section 120.60(3) of the Florida Statutes, however, any person who has asked the Department for notice of agency action may file a petition within twenty-one days of receipt of such notice, regardless of the date of publication.

The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing. The failure of any person to file a petition within the appropriate time period shall constitute a waiver of that person's right to request an administrative determination (hearing) under sections 120.569 and 120.57 of the Florida Statutes. Any subsequent intervention (in a proceeding initiated by another party) will be only at the discretion of the presiding officer upon the filing of a motion in compliance with rule 28-106.205 of thc Florida Administrative Code.

A petition that disputes the material facts on which the Department's action is based must contain thc following iriformation:

(a) The name, address, and telephone number of each petitioner; the name. address, and telephone number of the petitioner's representative, ifany; the Department case identification number and the county in which the subject matter or activity is located; (b) A statement of how and when each petitioner received notice of the Department action; (c) A statement of how each petitioner's substantial interests are affected by the Department action; (d) A statement of all disputed issues of material fact. Ifthere are none, the petition must so indicate; (e) A statement of facts that the petitioner contends warrant reversal or modification of the Department action; (f) A concise statement of the ultimate facts alleged, as well as the rules and statutes which entitle the petitioner to relief; and (g) A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wants the Department to take.

A petition that does not dispute the material facts on which the Department's action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by rule 28-106.301.

Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Department's final action may be different from th'e position taken by it in this notice. Persons whose substantial interests will bc affected by any such final decision of the Department have the right to petition to become a party to the proceeding, in accordance with the requirements sct forth above.

Mediation under section 120.573 of the Florida Statutes is not available for this proceeding.

This action is final and effective on the date filed with the Clerk of the Department unless a petition is filed in accordance with the above. Upon the timely filing of a petition this order will not be effective until further order of the Department.
