2.D~BkdSt.LucieTechnical Specification (TS)3/4.11.2.5, Explosive GasMixfure,provideslimitsandmonitoring requirements forcombinations ofoxygenandhydrogeninthewastegasdecaytanksforeachPSLunit.ThepurposeofSpecification 3/4.11.2.5 andassociated instrumentation operability requirements (formerly TS3/4.3.3.10) istoprovideassurance thatunacceptable mixturesofoxygenandhydrogenwillbedetectedandmitigated duringoperations usingthewastegasholdupsystemateachunit.Thewastegasholdupsystemincludesthreetanksforthepurposeofreducingthetotalradioactivity byallowingradioactive decaypriortoreleasetotheenvironment.

Oneofthethreedecaytanksisnormallyalignedtoreceivewastegasfromtheprocessing systemandservesasthe"onservice"wastegasdecaytank.Dualgasanalyzers areinstalled inthewastegassystemtomonitortheoxygenconcentration ofthetypically hydrogenrichgases,andtherebyensurethatunacceptable mixturesofoxygenandhydrogencanbedetected.

Surveillance Requirement 4.11.2.5.1 currently requiresthattheconcentration ofoxygenshallbedetermined tobewithinthelimitsofSpecification 3.11.2.5by"continuously St.LucieUnit1andUnit2DocketNos.50-335and50-389ProposedLicenseAmendments ExlosiveGasMixtureMonitorin Reuirements L-98-125Attachment 1page2of5monitoring" thewastegasesintheonservicewastegasdecaytank.Theoxygenmonitoroperability requirements, however,arecontained intheUpdatedFinalSafetyAnalysisReport(UFSAR)foreachSt.LucieUnitandprovideaconditional exception tothe"continuously monitoring" criterion which,intheeventthatbothoftheinstalled oxygenmonitorsbecomeinoperable, allowsoperation ofthewastegasholdupsystemforupto30daysprovidedthatsamplesofoxygenareanalyzedusingthelabgaspartitioner atleastonceper24hours(Ref:PSL1UFSARSection13.8.1.4; PSL2UFSARSection13.7.1.4).

Theexplosive gasmonitoring instrumentation requirements wereformerlyinthefacilitytechnical specifications asTS3/4.3.3.10 andwererelocated totheUFSAR,withoutanychangestotheapprovedrequirements, consistent withGenericLetter(GL)95-10(Ref:LicenseAmendment Nos.147and86,PSL1andPSL2respectively:

8/20/96).

TS3/4.11.2.5 wasnotaddressed bytherelocation process,andSurveillance Requirement 4.11.2.5.1 specified thatthewastegasesintheonservicewastegasdecaytankshallbecontinuously monitored "withtheoxygenmonitorrequiredOPERABLEbyTable3.3-13ofSpecification 3.3.3.10."

Aspartofanadministrative updatetotheSt.LucieTS,thereference to"withtheoxygenmonitorrequiredOPERABLEbyTable3.3-13ofSpecification 3.3.3.10" wasremovedfromSurveillance Requirement 4.11.2.5.1 sincetheinstrumentation TSnolongerexisted(Ref:LicenseAmendment Nos.152and89,PSL1andPSL2respectively:

9/22/97).

However,aconditional modifierforthe"continuously monitoring" criterion wasnotincludedwiththeadministrative updatetoreflecttheactionthathadbeenapprovedforimplementation whenbothinstalled oxygenmonitorsbecomeinoperable andwhichhadbeenrelocated totheUFSAR.OnNovember21,1997,NRCInformation Notice(IN)97-80,LicenseeTechnical Specifications

/nterprefations, wasissuedtoalertlicensees toproblemsidentified withlicenseeTSinterpretations.

IN97-80states,inpart,"Licensee TSinterpretations canenhancethesafeoperation oftheplantbyhelpingtheplantstaffunderstand andcorrectly implement TSrequirements.

However,licensees mustexercisecautiontoensurethatTSinterpretations donotchangethewording,themeaning,ortheintentofTSrequirements."

Similarly, NRCInspection ManualPart9900,TechGuidance, LicenseeTS/nterprefations (2/3/97)concludes, inpart,"Asstatedearlier,themostimportant factoristhattheTSinterpretation doesnotconflictwithTSwordingorintent."..."Reliance onaTSinterpretation whenanerrorisdiscovered intheTSisnotacceptable.

TheNRCexpects St.LucleUnit1andUnit2DocketNos.50-335and50-389ProposedLicenseAmendments ExlosiveGasMixtureMonitorin Reuirements L-98-125Attachment 1Page3of5licensees tocomplywiththeexplicittermsofTSorapplyforalicenseamendment, pursuantto10CFR50.90,tochangetheTStermsratherthanrelyingonaTSinterpretation orengineering analysestojustifyatemporary departure fromTSrequirements.

IntheeventthatanerrorinTSisdiscovered, thelicenseeshouldrestrictplantoperations, asappropriate, untilanamendment canbeprocessed orotheracceptable actionsaretaken."Compliance withtheexplicittermsofSurveillance Requirement 4.11.2.5.1, aspresently stated,cannotbeachievedunlessatleastoneoxygenmonitoriscontinuously monitoring thewastegases,orunlessthewastegassystemisalignedtobypassthewastegasdecaytanks.3.0ProosedChanes:DescritionandBases/Justification Attachment 3containscopiesoftheaffectedTSpagesmarked-up toshowtheproposedchanges.3.1DescritionofChanestoTS4.11.2.5.1 (a)Addanasterisktotheword"continuously,"

However,operation ofthewastegasholdupsystemcancontinueifthesystemisalignedtobypassthewastegasdecaytankswhichwouldthenmakethesurveillance notapplicable.

Thisconstraint inadvertently evolvedfrompreviouslicenseamendments issuedduring1996and1997(Nos.152and147forPSL1;Nos.89and86forPSL2)whichrelocated theexplosive gasmonitoring instrumentation operability requirements (formerly TS3/4.3.3.10) toChapter13oftheUFSARforeachSt.Lucieunit,andthendeletedthereference totheseoperability requirements fromSurveillance Requirement 4.11.2.5.1 aspartofanadministrative update'to technical specifications.

TheUFSARoperability requirements fortheWasteGasDecayTanksExplosive GasMonitoring Systemcontainan"ACTION1"whichappliesintheeventatleastoneoxygenmonitorisnotOPERABLEduringwastegasholdupsystemoperation.

ACTION1providesforoperation ofthewastegasholdupsystem"tocontinueforupto30daysprovidedsamplesofoxygenareanalyzedbythelabgaspartitioner atleastonceper24hours."Therewerenochangestotheoperability requirements orthesubjectACTIONstatement fortheexplosive gasmonitoring instrumentation duringtherelocation process,andtherequirements intheUFSARarethesameasprovidedinformerTS3/4.3.3.10.

TheproposedrevisiontoSurveillance Requirement 4.11.2.5.1 isadministrative innature,andwillmaketheliteralmeaningofthisspecification consistent withtheintended, andpreviously

approved, conditional exception tothecontinuous monitoring requirement intheeventthatbothinstalled gasanalyzers becomeinoperable.

Ifthecontinuous monitoring capability becomesinoperable, compliance withtheexplicittermsofthesurveillance requirement willbepossiblewithoutunnecessarily bypassing thewastegasdecaytanks.Operation ofthewastegassystemusinganonservicedecaytankisthepreferred alignment ofthewastegassystemtoallowstorageandadditional radioactive decaypriortoreleaseofwastegasestotheenvironment, andisconsistent withALARAobjectives.

Theproposedamendment involvesnosignificant increaseintheamountsandnosignificant changeinthetypesofanyeffluents thatmaybereleasedoffsite,andnosignificant increaseinindividual orcumulative occupational radiation exposure.

FPLhasconcluded thattheproposedamendment involvesnosignificant hazardsconsideration andmeetsthecriteriaforcategorical exclusion setforthin10CFR51.22(c)(9) andthat,pursuantto10CFR51.22(b),

anenvironmental impactstatement orenvironmental assessment neednotbepreparedinconnection withissuanceoftheamendment.

5.0 Conclusion

Aninconsistency betweenExplosive GasMixfureTS3/4.11.2.5 andtherequirements fortheWasteGasDecayTanksExplosive GasMonitoring Sysfemcontained intheUFSARwasinadvertently createdbypreviouslicenseamendments.

Compliance withtheexplicittermsofSurveillance Requirement 4.11.2.5.1, aspresently stated,preventsimplementation ofapreviously approvedactionforacasewherecontinuous monitoring capability foroxygenconcentration inwastegasesbecomesinoperable, andwouldresultinunnecessarily bypassing theWasteGasDecayTanks.Theproposedamendments areadministrative innature,andareconsistent withregulatory guidanceinvolving TSinterpretations.

Pursuantto10CFR50.92,adetermination maybemadethataproposedlicenseamendment involvesnosignificant hazardsconsideration ifoperation ofthefacilityinaccordance withtheproposedamendment wouldnot:(1)involveasignificant increaseintheprobability orconsequences ofanaccidentpreviously evaluated; or(2)createthepossibility ofanewordifferent kindofaccidentfromanyaccidentpreviously evaluated; or(3)involveasignificant reduction inamarginofsafety.Eachstandardisdiscussed asfollows:(1)Operation ofthefacilityinaccordance withtheproposedamendment wouldnotinvolveasignificant increaseintheprobability orconsequences ofanaccidentpreviously evaluated.

Theproposedlicenseamendments areadministrative innatureandwillrectifyaninconsistency betweenSurveillance Requirement 4.11.2.5.1 andtheUFSARthatwasinadvertently createdbypreviouslicenseamendments.

Therevisions willreinstate apreviously approvedconditional exception totheexplicittermsofthepresently statedTSrequirement tocontinuously monitorthewastegasesintheonserviceWasteGasDecayTank,andallowlimitedsystemoperation usingthelaboratory gaspartitioner toperiodically analyzegassamplesintheeventthatcontinuous monitoring capability becomesinoperable.

Limitsforpotentially explosive mixturesofwastegaseshavenotbeenaltered,andexplosive gasmonitoring instrumentation doesnotpreventormitigatedesignbasisaccidents ortransients whichassumeafailureoforachallenge toafissionproductbarrier.Theproposedrevisions donotinvolveanychangetotheplantaccidentanalysesassumptions, anddonotinvolveaccidentinitiators.

Therefore, operation ofeitherfacilityinaccordance withitsproposedamendment wouldnotinvolveasignificant increaseintheprobability orconsequences ofanaccidentpreviously evaluated.

Theproposedlicenseamendments areadministrative innatureandrectifyaninconsistency betweenTechnical Specification 4.11.2.5.1 andtheUFSARthatwasinadvertently createdbypreviouslicenseamendments.

Therevisions willnotchangethephysicalplantor,themodesofplantoperation definedintheFacilityLicenses.

Thechangesdonotinvolvetheadditionormodification ofequipment nordotheyalterthedesignofplantsystems.Therefore, operation ofeitherfacilityinaccordance withitsproposedamendment wouldnotcreatethepossibility ofanewordifferent kindofaccidentfromanyaccidentpreviously evaluated.

(3)Operation ofthefacilityinaccordance withtheproposedamendment wouldnotinvolveasignificant reduction inamarginofsafety.Theproposedlicenseamendments areadministrative innatureandrectifyaninconsistency betweenSurveillance Requirement 4.11.2.5.1 andtheUFSARthatwasinadvertently createdbypreviouslicenseamendments.

Therevisions willreinstate apreviously approvedconditional exception totheexplicittermsofthepresently statedTSrequirement tocontinuously monitorthewastegasesintheonserviceWasteGasDecayTank,andallowlimitedsystemoperation usingthelaboratory gaspartitioner toperiodically analyzegassamplesintheeventthatcontinuous monitoring capability becomesinoperable.
