Dear Tim,

On November 16, 2022, US Nuclear Regulatory Commission (NRC) staff and TMI-2 Solutions had a clarification call on certain TMI-2 Solutions Responses to Request for Additional Information (RAIs) dated September 29, 2022, (Agencywide Document Access and Management System (ADAMS) Accession No. ML22276A024) on Material Control & Accountability (MC&A) in response to RAIs issued on July 29, 2022 (ML22210A080, pkg; RAI Enclosure ML22210A088).

NRC asked TMI-2 Solutions to clarify whether TMI-2 Solutions intends to meet the MC&A requirements regarding one gram or more of Special Nuclear Material (SNM) as required 10 CFR Part 74, Material Control and Accounting of Special Nuclear Material. TMI-2 Solutions RAI response to RAIs 10, 12, and 13 states more than one gram of SNM as opposed to one gram or more of SNM.

Further, on the clarification call, the NRC requested TMI-2 Solutions to clarify on response to RAI 11 whether the security personnel are notified of all reportable requirements of the 10 CFR 74.11(a), not just upon detection of loss or theft or attempt theft. Also, the NRC staff asks that TMI-2 Solutions clarify whether they confirm or commit to that all requirements of 10 CFR 74.11(a) are addressed or will be addressed in TMI-2 Solutions procedure TMI-2-RA-PR-005 if the license amendment request is approved before the implementation date.

I have attached a copy of your RAI responses (see RAIs 10, 12, and 13) with areas that I have highlighted in yellow where the NRC staff is asking for clarification as indicated above.

Since your clarification will be used in the staffs Safety Evaluation Report (SER),

please submit your response under oath and affirmation. We agreed during the clarification call that TMI-2 Solutions would provide a response via email as soon as it can and an official response under oath and affirmation along with the other RAI responses that TMI-2 Solutions intends to submit on or about November 22, 2022.

The staff will finalize the MC&A SER input upon reviewing the response submitted on or about November 22, 2022.
