PENNSYLVANIA STATE UNIVERSITY - 2019 TRIENNIAL UPDATE TO DECOMMISSIONING FUNDING PLAN AND DECOMMISSIONING COST ESTIMATE, SPECIAL NUCLEAR MATERIAL LICENSE SNM-95, DOCKET 07000113 (CAC/EPID A38003/07000113/L-2019-DFA-0016)

By letter dated December 12, 2019 (Agencywide Documents Access and Management System
[ADAMS] Accession Number ML19350B163), you submitted to the U.S. Nuclear Regulatory Commission (NRC) the triennial update to the Pennsylvania State University (PSU)
Decommissioning Funding Plan (DFP) required by Title 10 of the Code of Federal Regulations (10 CFR) Paragraphs 70.25(e)(2) for the SNM-95 Special Nuclear Materials License. The financial instrument used by the PSU was a self guarantee (SG), consistent with 10 CFR 70.25(e)(2)(f)(2) for a nonprofit entity, such as a college or university. This was submitted for review in separate correspondence (ADAMS Accession No. ML19357A042) dated December 19, 2019. The DFP update is to include a detailed decommissioning cost estimate (DCE) for meeting the criteria of the 10 CFR 20.1402, Radiological criteria for unrestricted use.
Following initial receipt, an acceptance review of your submittal was performed, and identified no administrative omissions or deficiencies that would prevent proceeding with a detailed review. This acceptance was sent to you, by e-mail dated January 22, 2020 (ADAMS Accession No. ML20022A087). There were no deficiencies identified in the detailed review. The Financial Assessment Branch of the Division of Rulemaking, Environmental, and Financial Support in the Office of Nuclear Material Safety and Safeguards conducted the technical review of the adequacy of the submittal for SNM-95.
The PSU is required to submit a DCE to the NRC for review and approval as a part of the DFP update. By letter dated May 11, 2020 (ADAMS Accession No. ML20118C220), the NRC staff concluded that the SG satisfies the requirements of 10 CFR 70.25(e)(1), is consistent with NUREG-1757, Vol. 3, Rev. 1, Consolidated Decommissioning Guidance Financial Assurance, The documents transmitted contain security-related information. When separated from Enclosure 2, the remaining documents are decontrolled.

Enclosure 2 of this letter will be unavailable to the public in accordance with 10 CFR Paragraph 2.390(d).
