WITHDRAWAL OF REQUEST FOR ADDITIONAL INFORMATION

Dear Mr. Boeldt:

The staff at the U.S. Nuclear Regulatory Commission (NRC) sent a letter dated March 13, 2013, requesting additional information in regards to the annual certification of the parent company guarantee dated November 16, 2012. On March 20 and 21, 2013, we had a conference calls as a result of the questions you raised about the applicability of the request for additional information (RAIs) and safety. The RAIs stemmed from a decommissioning rule that became effective in December 2012, after the annual certification was submitted to the NRC in November 2012.

The NRC staff agrees that the RAIs dated March 13, 2013, are not applicable for the November 16, 2013, submittal. As such, NRC staff is withdrawing these RAIs. Please note that the subjects addressed by these RAIs will be applicable for future submittals for the annual certification of the parent company guarantee.

In accordance with Title 10 of the Code of Federal Regulations 2.390 of the NRC's "Rule of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records System component of the NRC's Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC web site at http://www.nrc.gov/reading-rm/adams.html (The Public Electronic Reading Room).
