I am responding to your letter of september 12, 1994, addressed to Ivan Salin, Chairman of the Nuclear Regulatory Commission .,

l l (NRC). In your letter you state that you are having difficulties _

obtaining the records you requested pursuant to the Freedom of Information Act (FOIA).

I have reviewed the chronology of your FOIA request and note that your request has not been fulfilled because you have not paid -'

l the estimated fees. Under our regulations (10.CFR 9.40(d)), an l advance payment is required when the estimated fees will exceed l

$250.00. Also, the policy for granting fee waivers focuses on -

the benefit to be derived by the general public, not on the requester or on the requester's financial situation. Indigence alone, without evidence showing a public benefit, is insufficient to warrant a fee waiver. ,

on several previous occasions you were informed that you must pay the fees required for processing your FOIA request. By letter of March 4, 1994, you were also provided a copy of the requirements of 10 CFR 9.41 for filing a fee waiver request. For your information, I have enclosed a summary of our actions in l

processing your request.

Since you have not paid'the required fees or ptovided any justification for our granting you a fee waiver, I have determined that the response to you of May 16r 1994, from Mr.

Walter oliu (copy enclosed), was proper and no further action is warranted at this time. If you have any questions concerning this matter, please contact.Mr. Russell A. Powell, Chief, Freedom of Information and Local Public Document Room Branch on 301-415-l 7169.
