l I am responding to your letter ober 2 1994, forwarding an l
inquiry from your constituting, concerning the g-i Nuclear Regulatory Commission' response'to his Freedom of I
Information Act (FOIA) request.
l On October 6, 1994, we responded to September 12, i
1994, letter to Chairman Selin.
In that response, we explained that NRC regulations (10 CFR 9.40(d)) require advance payment of l
FOIA fees when it is estimated that the fees will exceed $250.00.
l He was also advised that a requester's inability to pay fees i~s Eh ? "
not a basis for NRC to grant a request for waiver of FOIA fees.
