IE REVIEd 0F CORRESPONDENCE WITH LICENSEES CONCERNING CERTAIN ENFORCEMENT MATTERS I
I have noted one or two instances where Regions are responding without IE review to licensees who contest citations which initially received IE review and concurrence. Responses involving the sustaining or withdrawal of any such citations, whether Severity Level III or IV, should be sent to IE for review and concurrence. This is particularly true in the case of material false statements which are issued as Severity Level.III's without civil penalties and which are contested by the licensee.
I would also like to remind you of our longstanding policy that actions which fit the examples containe:! in the Enforcement Policy for Severity L.evel III or higher and which are bein; proposed at a Severity Level IV by the Region should be sent to IE headquarters for concurrence. We have been successful in handling j these on a five day turna-ound. ,
