NOTIFICATION OF CONGRESSIONAL AFFAIRS AND PUBLIC AFFAIRS OF DELAYED ISSUANCE OF AN ENFORCEMENT PACKAGE (EGM 85-01)

An enforcemnt notification (EN) is issued to provide early notification to the Commission of the Staff's intent to issue an enforcement package which proposes imposition of a civil penalty. The EN is considered preliminary information and should not be disclosed outside of the NRC until after the licensee has been notified of the proposed enforcement action. The date that the proposed enforcement action is to be issued is stated in the EN and is usually three working days af ter the date of .t,he EN. The Office of Congressional Af fairs sends the information contained in the EN to the " appropriate Congressional committees on the release date stated in the EN. Therefore, a delay in issuance of the enforcement package without notification of Congressional Affairs will result in a premature release of information.

To prevent the premature release of pending enforcement information, any time I

that a proposed civil penalty will not be signed by the Regional Administrator i on the date specified in the EN, the cognizant Regional Enforcement person should notify the Enforcement Staff on the day before the action is to be released so that they can notify the Offices of Congressional Affairs and Public Affairs of the delay in the issuance and caution them about the premature release of information. If the notifications are not made the day before the package was to be released, the Regions will have to issue the package on the originally specified date.
