l ear Dr. h On November 21, 1993, you submitted a Freedom of Information Act (FOIA) request for all records concerning yourself. On February 18, 1994,

! Mr. Russell Powell sent you a Statement of Estimated Fees informing you that the fees for processing your request were anticipated to amount to $262.40 . -.

I and, in accordance with NRC's regulations (10 CFR 9.40(d)), requested an advance payment of that amount.

On February 25, 1994, you requested a waiver of those fees because of hardship-  !

reasons. On March 4,1994, Mr. Powell informed you that your February 25th l letter did not contain sufficient infomation for NRC to make a fee waiver ~~

determination and that NRC does not waive fees due to hardship reasons.

On April 1,1994, you requested that copies of the records be sent to you (and three other individuals) as soon as possible. On April 11, 1994, Mr. Powell again informed you that an advance payment in the amount of $262.40 or a fomal fee waiver request was necessary in order for NRC to process yr,ur request. He also informed you that an advance payment of $116.80 was required ~

for each additional set of the records.

Since we have not received the fee payment or a formal fee waiver request, we are closing our file on your FOIA request. .

This denial of your fee waiver request may be appealed to the Executive Director for Operations within 30 days of the receipt of this letter. Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555, and should clearly state on the envelope and in the letter that it is an " Appeal of an initial Fee Waiver Denial."
