Braidwood Units 1 and 2 Byron Unit 2 By letter dated July 30, 1987 Commonwealth Edison withdrew its application to transfer ownership of Byron Unit 2 and Braidwood Units 1 and 2 to a wholly-owner subsidiary. On July 16, 1987, the Illinois Commerce Commission denied l

Commonwealth Edison's petition seeking approval of the transfer of ownership, making its application to the NRC moot. Commonwealth Edison is considering its options and may submit a new application in the future.

Beaver Valley Unit 2 l Beaver Valley Unit 2 achieved initial criticality on Tuesday, August 4, 1987 at 6:25 a.m. Low power physics tests are expected to continue through the week, observed by a special NRC inspection team, including Region I and NRR personnel. The tests and escalation to about 5% power are expected to be completed the weekend of August 7-10.

i l l Atlas License Renewal Denial l On July 31, 1987, Robert Martin, Regional Administrator for NRC Region IV,  :

issued a letter to Atlas Corporation denying the license renewal application for their Moab, Utah, uranium mill. The denial was accompanied by an immediately effective Order prohibiting further processing of uranium ore and  !

requiring provision of an effective, NRC-approved, financial-surety

arrangement as well as a detailed plan for decommissioning and decontamination l l of the milling facilities. The Order also requires continued care and l l

monitoring of the Moab site and directs Atlas to begin decommissioning and I

decontamination of the mill and reclamation of the tailings impoundment. ]

l l PECo Recovery Plan for Peach Bottom i Philadelphia Electric Company (PECo) is to handcarry a copy of its Recovery

& Plan for the Peach Bottom Plant to Region I headquarters on August 7, 1987. A press conference is to follow in which PECo will announce its Plan and its distribution to Governor William Schaefer, Maryland, and Thomas Kean, New ,

Jersey; all Senators and Representatives who have attended the public  !

meetings; and Harford County cfficials. l Differing Professional Opinions Special Review Panel j The initial meeting of the FY-87 Differing Professional Opinions Special Review Panel was held. Three subpanels were established to investigate and report on one of the following: the experience of other agencies in  ;

I Fe rmi-2 On August 4,1987, members of the NRC Headquarters and Region III staff met ,

with federal and provincial officials of Canada in Toronto. The purpose of this meeting wts address concerns raised by Canadian citizens about startup g problems being experienced at Fermi. Mr. Bert Davis, Region III Administrator, gave a detailed presentation that traced the history of construction, licensing and startup of Feimi. Mr. Davis identified majer problem areas, discussed license improvement programs and major regulatory activities, presented the results of the most recent SALP and concluded his presentation with an overview of current NRC activities at Fermi. Following this presentation, the staff answered specific questions raised by the Canadian officials.

H. B. Robinson Steam Electric Plant Unit 2 On Tuesday, August 4, 1987, Carolina Power and Light Company &L) placed Robinson 2 in the shutdown condition because of anomalies notc ' in environmental qualification (EQ) test results for certain cable splices.

Unsatisfactory test results were noted for two of 22 cable splice specimens tested. Test results indicated possible moisture intrusion into insulated butt splices.

The licensee is proceeding to bring the unit to the cold shutdown condition and will replace affected splices.

AUGUST 7, 1987 ENCLOSURE B

2 Pilgrim Offsite Emergency Preparedness Report On August 6, 1987 the Federal Emergency Management Agency (FEMA) provided a l report to the Nuclear Regulatory Commission on offsite emergency planning for l the Pilgrim Nuclear Power Station. Because of concerns brought to its attention, J FEMA initiated a review of its earlier (September 1982) finding that emergency preparedness for Pilgrim was adequate. Based on this self-initiated review, FEMA identified six issuc' regarding offsite emergency planning and preparedness '.

are inadequate to protect the public health and safety in the event of an accident at Pilgrim. The six issues identified by FEMA involve the evacuation of schools, a reception center for evacuees, the beach, special needs and transportation dependent populations, and the overall lack of general progress i in emergency planning. In its report, FEMA oresents an evaluation of each of the issues including the necessary actions required to correct the identified issues.

The Pilgrim plant is presently shutdown.

NRC TMI-2 CLEANUP PROJECT DIRECTORATE WEEKLY STATUS REPORT FOR AUGUST 3 - 10, 1987

1. DEFUELING

- Pick and place defueling of partial length fuel assemblies continued. Partial fuel assemblies E-12. E-13, F-10, F-11, F-12, i G-11 and D-13 were loaded into defueling canisters. A total of 68 fuel assemblies have been loaded into canisters.

- Five full canisters were transferred to the spent pool. ~0ne filled canister was placed in temporary storage in the deep end of the refueling canal.

2. ENVIRONMENTAL MONITORING

- US Environ? ental Protection Agency (EPA) sample analysis results show that TMI site liquid effluents are in accordance with i regulatory limits, NRC requirements, and the City of Lancaster Agreement. l

- TMI intake water and water effluents from the station (Units 1 and 4

2) discharge are analyzed by EPA. Gamma spectrum analyses of the l seven daily composited samples for July 18 - 25, 1987 indicated no reactor related activity.

- EPA's gamma spectrum analysis of the NRC's TMI outdoor air sample for July 30 - August 6,1987 showed no reactor related radioactivity.

3. DECONTAMINATION ACTIVITIES

- Decontamination efforts continue in the seal injection valve room.

Reactor building basement sludge is being prepared for transfer from the spent resin storage tanks to liners for solidification.

_It_ ems of Interest Week Ending August 7, 1987 INDUSTRIAL AND MEDICAL NUCLEAR SAFETY Rod Consolidation Demonstration At the invitation of the Department of Energy, an NRC staff member attended a proposed dry rod consolidation technology demonstration on July 23, 1987, at DOE's Idaho National Engineering Laboratory. While a crane malfunction delayed this demonstration, over 20 fuel assemblies have been consolidated in this initial program, achieving a fuel rod consolidation ratio of 2 to 1.

Consolidation of non-fuel bearing assembly components is not part of this initial effort, but will be addressed in a future project. This program provides a basis for a follow-on Prototypical Consolidation Demonstration Project which has the objective of developing dry rod consolidation for the Monitored Retrievable Storage facility.

URENC0 On July 30, 1987, staff met with representatives of URENC0 to discuss their preparation of a licensing basis document which would illustrate how they intend to proceed with their application. The main thrust of the document would be the applicability of each section of 10 CFR Part 50 to uranium

,g enrichment licensing.

Babcock & Wilcox (B&W), NNFD Research Laboratory Materials License No. SNM-778 issued originally to B&W Lyncburg Research Center (LRC) was renewed on July 30, 1987, for a five year period. In 1987, the LRC merged into the B&W Naval Nuclear Fuel Division and will be known as the NNFD Research Laboratory. The Licensee is authorized to conduct research and development activities of ucanium fuel and testing of irradiated fuels.

, Medical Uses of Radioisotopes Course The NRC Medical Uses of Radioisotopes Course will be held in San Antonio, Texas during the week of August 17th. Fifteen NRC material inspectors and licensing reviewers will be attending the course.

STATUS OF HEARINGS j j

Sequoyah Fuels, Gore, Oklahoma, Comprehensive Waste Disposal Plan Sequoyah Fuels Corporation submitted the Comprehensive Radiological Solid Waste Management Plan as required by Source Material License No. SUB-1010, Condition l 21 on November 13, 1986. There has not been a schedule set for this proceed- l ing. On March 25, 1987, Sequoyah Fuels Corporation petitioned for termination of the proceeding on the basis that no onsite disposal is now planned. The staff is not a party to the proceeding, but has responded to a request from the Presiding Officer for its views on the status of Sequoyah Fuels' actions that ,

l would support its petition. Subsequently, on June 26, 1987, the Presiding {

Officer deferred ruling on SFC's motion to terminate the proceeding pending  !

l completion of its efforts to implement the new Plan and required SFC to file a report on the status of those (iforts within five days. Staff responded to the i status report on July 28, 198/, recommending that the Presiding Officer withhold  !

further action pending Region IV's decision regarding Quivira Mining Company's 1 application to process raffinate sludge. i

? l LOW-LEVEL WASTE MANAGEMENT l Low-Level Radioactive Waste Policy Act, as Amended Meeting with Northeast Utilities On July 30, 1987, NMSS staff meet with Robert Bishop of Northeast Utilities and Brian Farrell of EEI. The purpose of the meeting was to discuss extended storage of non-reactor, low-level radioactive wastes at existing operating reactor sites. The industry representatives identified several issues which they believed would be detrimental to using a reactor site for extended, g long-term storage of low-level wastes. Some of the disadvantages identified by the industry representatives included (1) the diversion of management attention away from reactor operation; (2) the inequity of having the electrical ratepayer assume the costs of commercial low-level waste storage; (3) the adverse impact the extended long-term storage would have on meeting the goals and objectives of the Low-Level Radioactive Waste Amendments Act; and (4) the technical undesirability of using a reactor site fnr low-level waste storage.

Low-Level Waste Disposal Mixed Waste On Monday, August 3, Dr. J. Winston Porter, EPA Assistant Administrator, signed a joint guidance document on mixed-waste disposal units. This is the third and last joint guidance document to be issued by NRC and EPA on mixed waste disposal. In combination, the three documents provide guidance to mixed-waste generators and potential disposal-site operators addressing the three principal areas where NRC low-level waste legislation and regulations differ from EPA hazardous-waste legislation and regulations.

3 Uranium Recovery Atlas License Renewal Denial On July 31, 1987, Robert Martin, Regional Administrator for NRC Region IV, issuea a letter to Atlas Corporation denying the license renewal application for their Moab, Utah, uranium mill. The denial was accompanied by an immediately effective Order prohibiting further processing of uranium ore and requiring provision of an effective, NRC-approved, financial-surety arrangement as well as a detailed plan for decommissioning ar.d decontamination of the milling facilities. The Order also requires continued care and .

monitoring of the Moab site and directs Atlas to begin decommissioning and decontamination of the mill and reclamation of the tailings impoundment. ,

The action was taken after Atlas Corporation was unable to provide arrangements, acceptable to the staff, for assuring that funds would be available to pay for decommissioning, decontamination and reclamation activities at the Mcab mill. The staff's action in this matter was proposed in a Commission Paper (SECY-87-158), approved by the Commissioners, and coordinated with the Office of Governmental and Public Affairs. j HIGH-LEVEL WASTE MANAGEMENT  ;

i Definition of HLW Comments from the Department of Energy dated July 28, 1987, were received on the Commission's Advance Notice o' Proposed Rulemaking regarding the definition of high-level radioactive waste (HLW). The Department considers l the approach of defining HLW based on its hazardous characteristics, rather than its source, to be reasonable and technically sound. DOE also provided g responses to the specific issues raised by the Commission in its ANPR. Staff is proceeding with its analysis of the public comments received on the ANPR and development of the proposed rule.

SAFEGUARDS Status of IAEA Safeguards at Westinghouse Columbia Following the partially successful physical inventory verification (PIV) by the IAEA at Westinghouse in January 1987, several meetings have been held with the IAEA and Westinghouse to develop a set of procedures to insure a successful conduct of the next PIV scheduled for the end of December 1987. Details of the procedure were finalized last week in a meeting between NRC and Westinghouse.

NRC plans to discuss the details of these procedures with the Department of St&te and, in turn, the IAEA next week.

NRC Region I/New Jersey Letter Agreement The New Jersey Department of Environmental Protection and NRC entered into a letter agreement regarding the surveillance of nuclear power plants operating in New Jersey. In the first joint activity under the agreement, the NRC Regional Administrator and members of the Bureau of Nuclear Engineering staff l toured the Hope Creek Nuclear Station on August 4. Commissioner Dewling of the New Jersey Department of Environmental Protection stated in his August 3, 1987, letter acknowledging the terms and conditions of the agreement that the agreement provided a substantive way for the State to meet its responsibility to protect its citizens and the environment by actively participating in the surveillance of the three nuclear plants operating in New Jersey.

Marie Miller, Regional State Liaison Officer, met with the New Jersey Bureau of Nuclear Engineering Chief to discuss organization responsibilities and notification contacts during the Hope Creek tour.

PECo Recovery Plan for Peach Bottom Philadelphia Electric Company (PECo) is to handcarry a copy of its Recovery Plan for the Peach Bottom Plant to Region I headquarters on August 7, 1987. The following are nuclear issues considered by the Environment, Natural Resources and Energy Committee:

1. The Committee voted to keep existing policies which:

a. requests Congress to clarify the authority of DOE to provide for strict liability on the part of the Federal government with full indemnification for any Stata in which an accident occurs during the transportation or disposal of high-level nuclear waste.
b. supports a number of positions relative to low-level and high-level radioactive waste management, including urging the NRC to continue to explore alternatives to land burial of low-level waste, and encouraging NRC to establish a " Class D" of low-level waste that would be a Federal responsibility. (NOTE: Michigan Senator Ehlers committed to rewrite this policy for the December meeting and include issues of concern to .the Michigan LLW Compact Commissioner.)

c. advocates reauthorization of the Price-Anderson Act with certain additions and clarifications.
2. The Committee had on its agenda a new proposed policy on reorganization of the NRC, which urged replacing the Commission with a single Administrator. Because of time constraints, this policy was never brought before the Committee and will likely be considered at the Federal / State Assembly in December in Washington.

! Week Ending August 7 The initial meeting.of the FY-87 Differing Professional Opinions Special Review Panel was held. Three subpanels were established to investigate and report on one of the following: the experience of other' agencies in implementing DP0-like programs; the adequacy of current NRC guidance on the DP0 process; and observations and suggestions of individuals who have had experience with the NRC DP0 process. The next meeting of the Special Review Panel and subpanel chairpersons is scheduled for August 18.

The first of three scheduled sessions of " Effective Communication: Media Training Workshop" was held on August 5,1987. Designated Incident Investigation Team leaders and senior management personnel spent a day being coached on how to respond clearly and effectively to questirns by the media.

The workshop also included several live video-taped interviews and instant critiques.

conducted a debriefing for the headquarters participants in FFE-2. A 1 description of the scenario and lessons learned were presented and discussed.

The draft Lessons Learned Report was distributed to key participants on l July 31, 1987.  !

On August 6, 1987, the Chief, IRB and several members of his staff met with  !

representatives from the Office of Nuclear Regulatory Research (RES) to:  !

The action was based on violations involving the failure to (1) calibrate primary beam calibration instruments at intervals not to exceed twenty-four months, (2) perform an annual review of the Radiation Safety Program, (3) perform timer constancy and linearity measurements during the monthly output spot-checks of the teletherapy unit, (4) survey patients treated with temporary implants l

upon removing the last temporary implant source, and (5) count the number.
