SUBJECT:

FINAL RULE ON MATERIAL BALANCE REPORTS (10 CFR PARTS 40, 70, 74,150)

We have reviewed the subject rule and have deterinined that an additional change is needed. As the rule presently stands, power reactor licensees would be required to continue submitting Form 7420. After further consideration of this requirement, we have determined that the information submitted on this form is not needed for the inspection of power reactors. Therefore, we recommend that the requirement to submit this form be eliminated for pcwer reactors. However, rather than delay the present rule package, we have decided to concur in the rule and request that our recommendation be incorporated into a future rule-making. Per discussions with members of your staff, it was agreed that this request will be dealt with in a follow-up rule.

Your staff also agreed to remove the statement on page 2 of the Federal Fegister Notice in which NRC states it did not include nuclear reactors becauso the information is needed to carry out the inspection and enforcement fbnctjon.
