E MORANDUM FOR:

John G. Davis, Director Office of Nuclear Material Safety and Safeguards FROM:

James M. Taylor, Director Office of Inspection and Enforcement

SUBJECT:

FINAL RULE ON MATERIAL BALANCE REPORTS (10 CFR PARTS 40, 70,

'I 74, 150)

We have reviewed the subject rule and have determined that an additional change is needed before we can concur.

As the rule presently stands, power reactor licensees would be required to continue submitting Form 742C.

After-further consideration of this requirement, we have determined that the information submitted on this form is not needed for the inspection of power reactors.

Therefore, we recommend that the requirement to submit this form be eliainated for power reactors.
