EXEMPTION FROM 10 CFR 70.24

Background

By application dated July 28, 1978, RPI has requested an exemption from the provisions of 10 CFR 70.24 as that section applies to materials held under NRC Materials License No. SNM-910.

Discussion Condition No. 14 of SNM-910 restricts the possession limit under the license to one effective kilogram of special nuclear material.

Of this quantity, 300 grams of U-233 is in the form of fuel rods stored in shipping containers and 193 grams of plutonium is in the fonn of Pu-Be neutron sources at various laboratory locations on the campus. Further the licensee states that there is no area where the possession limit exceeds 700 grams U-235, or 520 grams U-233, or 450 grams of Pu or of any combination of these special nuclear materials. Under these conditions, the possibility of accidental criticality is essentially nil.

Conclusion The staff concludes based on the above statements that granting an exemption from the provisions of 10 CFR 70.24 will not endanger life or property or the conmon defense and security, and is in the public interest. This exemption is authorized pursuant to 10 CFR 70.14.

Reconmendation Based on the above, the staff recommends that an exemption as follows be made a condition of the license: ,

2 OCT I 0 1978 The licensee is hereby exempted from the provisions of 10 CFR 70.24 insofar as this section applies to materials held under this license, and provided that no more than 450 grams of special nuclear material, excluding encapsulated Pu-Be neutron sources, held under this license is present in any one room at any time.
