MOTION TO AMEND CONTENTION 6A OF INTERVENOR'S AMENDED CONTENTIONS FILED NOVEMBER 1,1978 Pursuant to 10 C.F.R. S 2. 714 (a) (3) the State of Illinois requests the chairman of the Atomic Safety and Licensing Board to j allow Contention 6A to be amended as follows:

6. There has been insufficient development of all 1 credible accident scenarios.

A. Accident scenarios considered in the Licensing Report issued February 3, 1978 appear to include only i single errors.

Intervenor requests this change be made for the following reasons:

1. As previously worded, the contention could have been .

construed to apply exclusively to criticality calculations. The Inter- f l

venor's intent in writing the contention was to question the development {

f of all accident scenarios by the Applicant. The amended wording reflects l this intent. l l

2, As previously worded the term of art " single operator error" could have been construed to refer to an existing NRC rule regulating criticality calculations; as such the contention could have been construed as an attack on an NRC rule or regulation, contrary to 10 C.F.R. S2.758. j h

The amendment is appropriate to avoid such an interpretation as the State of Illinois does not intend to challenge this particular regu-lation at this time.

Even if the amended contention 6A could be construed to be in derogation of the " single operator error" rule as formulated by the NRC, the amended contention lies within the exception carved by 10 C.F.R.

S2. 7 58 (b) in that the purposes for which the rule or regulation was adopted are not being challenged by this contention.

3. The amanded contention is relevant to the proceeding at hand as it questions the adequacy with which the Applicant considered all possible situations that could occur during the proposed pool modification. Double and triple error accidents are not rare. (See Appendix A, FER re Turkey Point) ; and in any major modification involving radioactive materials consideration must be given to the possibility that a single human error may be compounded by another human error and or a mechanical failure of a tool or system.

WHE REFORE the State of Illinois prays that the chairman will accept the amended contention 6A as stated and will admit said contention for consideration in the above referenced proceeding.
