BROWNS FERRY NUCLEAR PLANT, UNIT 3 WITHDRAWAL OF RELIEF REQUESTS REGARDING THIRD INTERVAL INSERVICE INSPECTION REQUIREMENTS OF THE ASME CODE (TAC NOS. MC8790 AND MC8792)

Dear Mr. Singer:

By letter dated October 19, 2005, the Tennessee Valley Authority (TVA) submitted Relief Request No. 3-PDI-2 for Browns Ferry Nuclear Plant (BFN) Unit 3 from the inservice inspection requirements of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code),Section XI, for the volumetric examination of reactor pressure vessel nozzle-to-vessel welds. The Nuclear Regulatory Commission (NRC) staff requested additional information pertaining to the difference between TVAs request and ASME Code Case N-613-1 endorsed in Regulatory Guide (RG) 1.147, Revision 14. TVA subsequently requested that the relief request be withdrawn in a letter dated May 25, 2006 as TVA will adopt the use of ASME Code Case N-613-1 as endorsed in RG 1.147.

By the same letter dated October 19, 2005, TVA submitted Relief Request No. 3-ISI-16 for BFN Unit 3 from the inservice inspection requirements of the ASME Code,Section XI, for pressure retaining piping welds subject to examination using qualified procedures, personnel and equipment. The NRC staff requested information as to the differences between this relief request and ASME Code Case N-695, which was endorsed in RG 1.147. Subsequently, TVA will adopt the use of this code case and withdrew this relief request in a letter dated May 25, 2006.

The purpose of this letter is to advise that the above cited applications are being treated as withdrawn. This completes the NRC Staff's review of Relief Requests 3-PDI-2 and 3-ISI-16 submittals under TAC Nos. MC8790 and MC8792.
