(Allens Creek Nuclear S Generating Station, Unit S No. 1) S APPLICANT'S RESPONSE TO JOHN F. DOHERTY'S CONTENTION #46 Applicant files this response to the motion of John Doherty (Intervenor) for admission into this proceeding of an untimely contention concerning BWR high rod worth events. For the reasons discussed below, the motion should be denied.

Intervenor John Doherty has filed yet another untimely contention in this proceeding, this one relating to a postulated assumption regarding the relationship between xenon concentrations and control rod worth in Boiling Water Reactors (BWRs). Inter-venor acknowledges that the contention is filed untimely; he seeks to have it considered by referring briefly to the factors set forth in 10 CFR 2.714 (a) (i) - (v) .

Clearly, all that Mr. Doherty has done is to paraphrase one portion of a recent NUREG document, " Review of Licensee Event Reports (1976-1978)" issued this past fall. As Mr. Doherty and its title acknowledge, the document, although dated 1979, dis-cusses events which occurred and were reported to the NRC in the 1976-78 period and which were the subject of a 1977 I&E 1937 243 soorovo s31

Circular (77-07). This does not qualify as an adequate showing of " good cause" under 10 CFR 2.714 (a) (i) .

The only other relevant factor for which Mr. Doherty pro-vides sor' substantive support is factor (iii), his potential for assisting in the development of a sound record.b/ Mr. Doherty surmises that "he may be reasonably capected to produce a witness or other evidence on this issue because of his callateral (sic) issue's activity." This faint assurance is not the calibre of showing required by 10 CFR 2.714 (a) (iii) . Mr. Doherty does not name an expert witness or even attempt to relate this issue to an associated one concerning which he has obtained such a witness.

This factor cannot, therefore, be weighed in his favor. See, Detroit Edison Company (Greenwood Energy Center), (ALAB-4 7 6 ) , 7 NRC 759 (1978).

Accordingly, Doherty contention 46 should not be admitted as an issue in this proceeding.
