" Bill of Exceptions Related to Order Ruling on TexPirg's Motion" served on December 7, 1973. NRC regulations have no provision for the filing of " exceptions", other than on appeal from an Initial Decision, 10 CFR S 2.762. TexPirg's " exceptions",

however, are apparently intended as a motion for reconsidera-tion of the Board's Order of November 30, 1973 (hereinafter

" Order") and will be treated as such in this response.

II. Grounds for Dismissal of " Exceptions" The filing by Tex?irg offers nothing new; indeed, as che " exceptions" state, the purpose of the filing is to simply reiterar.e the arguments in TexPirg's motion of October 30, 1973.

Each of Petitioner's numbered arguments is discussed briefly below:

. . (a) Contrary to Petitioner's first argument, the 3 card's Order is not based on principles of collateral estoppel or res judicata and that is expressly stated (Order,

p. 6);

(b) Arguments (2) and (3) have nothing to do with the reasons stated in the Order as grounds for denial of the motion.

(c) As to Petitioner's fourth argument, it should be clear by now that neither the scope of the 1975 hearing nor the Partial Initial Decision has anything to do with the constraints on contentions (i.e. "new information"; "new evid ace"; " changed designs") established by the 3 card. It is, instead, the original Notice of Hearing published in December, 1973 which is controlling. That Notice afforded an opportunity to intervene on all matters stated therein. By not having responded to that Notice by timely filing or ot2.erwise, TexF:.rg takes the case as it finds it -- in this case subject to the constraints established in the Corrected Notice of Inter-ventien ?rocedures.

The " Bill of Exceptions" should be denied for the foregoing reasons.
