Dear Dr. Denton:

og p Clinton Power Station Unit 1 Docket No. 50-461 Illinois Power Company (IP) on behalf of itself, and as agent for Soyland Power Cooperative, Inc. and Western Illinois Power Cooperative, Inc. herewith requests a two-year extension of the expiration date of the Construction Permit (CP) for the Clinton Power Station Unit 1. We request that the latost date for completion as specified in Construction Permit No. CPPR 137 be extended from October 1, 1981 to October 1, 1983.

The construction of Clinton Power Station Unit 1 has been delayed by the following:

1. Impact of modifications resulting from the accident at the Three Mile Island Nuclear Power Station.

2. Additional design verifications and controls imposed by stricter interpretation of standards, codes and regula-tions.

3. More extensive preoperational testing and startup requirements.

4. Construction delays caused by changes and increases in requirements resulting in material and equipment supplier problems.

5. Uncertainties and confusion resulting from licensing

Dre H2rold R. Dznton Auguot 31, 1981 Additionally, we also request that the following modifications be made to Section 3E of Construction Permit No. CPPR-137. These modifications would: 1) effectively update the CP to reflect changes that have been approved by various agencies since the CP was originally granted and 2) make changes that reflect the current policies of agencies responsible for various aspects of environmental protection covered in the CP. These requested changes are:

1. Reword 3E (1) to read:

"During the construction provided by this construction permit, the Applicant shall take the necessary mitigating actions, including those summarized on page lii, paragraph 7 (except for 7 (d)) and in Section 4.5 (except that the re-strictions on the use of herbicides shall be limited to using USEPA-approved materials in accordance with label directions) of the Final Environmental Statement (FES) dated October 1974, to avoid any unnecessary adverse environ-mental impacts from construction activities. Further, the Applicant shall follow the environmental monitoring programs described in Section 6 of the Environmental Report, with Amendments."

This change would incorporare the monitoring changes agreed to by the NRC staff as proposed in the amended Environmental Rcport and make herbicide use restrictions consistent with current USEPA policy.

2. Reword 3E(3) to read:

"Diccharges to Lake Clinton from Illinois Power Company, from Soyland Power Cooperative, Inc., and from Western Illinois Power Cooperative, Inc. sha'l not exceed an effluent temperature of 96oF, except that during such time as only one generating unit is in operation at the Clinton Power Station, the daily average discharge temperature shall not exceed 990F during more than 12 per cent of the hours in twelve-month periods ending with any month and shall at no time exceed 108.30F."

These changes would reflect the current thermal standard recently approved by the Illinois Pollution Control Board (IPCB) Order of May 28, 1981 (see attached).

February 24 , 11976. The need.for retaining these conditions has been. addressed in the IPCB' proceeding which culminated in.the'IPCB Order of May 28,:1981.. In the IPCB Opinion

.(June 25, 1981)'it found that "...none of these conditions remains necessary,"'thus they were-not included in the May 28th Order.- We, therefore, feel'it appropriate that the NRC delete these conditions from the CP as well.
