Dear Commissioner Prude,
I am the Licensing Boards principal law clerk assigned to this proceeding. I understand that, in connection with arranging with our administrative staff for the Boards use of the Midland County Courthouse, you have expressed an interest in speaking at the oral argument scheduled for July 10-11. In particular, I understand you have concerns about the potential adverse effects on oil production in the region in the event of an accident or terrorist attack at the proposed facility.
As indicated in the attached Board order of May 24, 2019, the July session in this adjudicatory proceeding will be limited to oral arguments concerning the standing and sufficiency of the hearing requests that were timely submitted by petitioners. Participation will be limited to counsel who have entered an appearance for either a petitioner, the applicant Interim Storage Partners LLC, or the U.S. Nuclear Regulatory Commission Staff.
This adjudicatory proceeding will not be an opportunity for anyone to offer oral limited appearance statements.
If you wish to submit a written statement, however, you may request it be received by the Board and placed in the docket in accordance with 10 C.F.R. § 2.315(a). Alternatively, an interested local governmental body may petition under 10 C.F.R. § 2.315(c) for a reasonable opportunity to participate in an evidentiary hearing that may be held at a later stage in this proceeding.

In accordance with the expressed preferences of all petitioners and of the NRC staff,1 the Board will hear oral argument concerning standing and the sufficiency of the hearing requests on Wednesday, July 10 and, as necessary, Thursday, July 11, 2019 in the Commissioners Courtroom at the Midland County Courthouse, located at 500 N Loraine Street, Midland, Texas. The Board will provide information in a subsequent order concerning the format for the argument. Unless changed by a subsequent order, the argument will commence at 9:00 a.m. Central Daylight Time (CDT).
Members of the public and representatives of the media are welcome to attend and observe. Participation will be limited, however, to counsel who have entered appearances for the petitioners, the NRC staff, and the applicant.
