Dear Mr. LeMunyon:

On behalf of Chairman Christopher T. Hanson, I am responding to your March 30, 2021, e-mail, which requested a meeting between the Chairman and Fasken Oil & Ranch to discuss the Interim Storage Partners (ISP) Consolidated Interim Storage Facility license application.

The ISP application is the subject of an ongoing adjudicatory proceeding with Fasken as one of the parties to that proceeding. The Commission must remain impartial during the pendency of the proceeding and it would therefore be inappropriate for the Chairman to meet with you and the Fasken representatives to discuss these contested matters.

A copy of your e-mail and this response will be served on the participants in the ISP Consolidated Interim Storage Facility proceeding.

Congratulations again on being named Chairman of the NRC by President Biden.

That is quite an honor! As a former appropriations committee staffer and Valpo alumni myself, you are making the Committee and the University proud!

Throughout my 20 years of government consulting and lobbying here in DC, I have worked on many issues specific to Texas. I used to work for a Texas Congressman. I recently took on a client matter that deals with an application for storage of high-level nuclear waste in Andrews County, Texas. Fasken Oil &

Ranch is a minerals development company (among many others) that is in the heard of the Permian Basin. As you probably know, they, and others, are interested in stopping the application. Obviously, Im simplifying the situation.

There are thousands of letters, comments, etc. both in favor and opposed to the high-level storage application. I would imagine that from the perspective of the NRC, this is not an easy issue to navigate.

REQUEST:

I have the top brass of Fasken Oil & Ranch in Washington, D.C. on April 14-16, 2021. I know that they would love the opportunity to brief you on their concerns regarding the application. I can promise you brevity.

Do you have some time the afternoon of the 14th or any time on the 15th to meet with my folks - either in person or by Zoom? It would be six of us: Ben Shepperd (Permian Basin Petroleum Association President/Director), Jimmy Carlile (Fasken O&R legislative liaison), Tommy Taylor (Fasken O&R Asst Gen Manager and Director of Oil and Gas Development), Lynda James (Fasken O&R General Manager and CFO), Monica Perales (Fasken in house counsel) and myself.

Please let me know! Thank you in advance for your consideration. Its probably kind of odd - having a meeting with all fossil fuel folks - but they have their concerns. I look forward to hearing from you! Let me know if you have any questions or if I can get you any additional information.
