U.S. NUCLEAR REGULATORY COMMISSION EVALUATION OF REVISION TO THE PHYSICAL PROTECTION PLAN, SAFEGUARDS CONTINGENCY RESPONSE PLAN, AND THE TRAINING AND QUALIFICATION PLAN FOR THE MIXED OXIDE FUEL FABRICATION FACILITY

Dear Mr. Gwyn:

On March 1, 2017, CB&I AREVA Mixed MOX Services (MOX Services) submitted revisions to the Physical Protection Plan (PPP), Safeguards Contingency Response Plan (SCRP), and the Training and Qualification Plan (T&QP) for the Mixed Oxide Fuel Fabrication Facility for review and approval (Agencywide Documents Access and Management System [ADAMS]

Accession Numbers ML17222A201, ML17096A721, and ML17096A771).

As stated in the enclosed Safeguards Evaluation Reports (SER), the U.S. Nuclear Regulatory Commission (NRC) staff has reviewed the changes requested by MOX Services in the revision of the PPP, SCRP and T&QP.

The methods and procedures outlined in MOX Services February 2017, Revisions of the PPP, T&QP, and SCRP satisfy the performance objectives, systems capabilities, and reporting requirements specified in Title10 of the Code of Federal Regulations (10 CFR) Sections 73.45 and 73.46, and Appendices B, C and H of Part 73. Therefore, NRC staff finds the MOX Services February 2017, Revisions to the PPP, T&QP, and SCRP are acceptable and provide high assurance that activities involving Special Nuclear Material are not inimical to the common defense and security and do not constitute an unreasonable risk to the public health and safety.

We are basing our conclusions and findings in the SER on the information provided by MOX Services. The PPP SER (Secret // Restricted Data) is provided under a separate cover. The T&QP, and SCRP SERs are attached as enclosures and are Official Use Only - Security Related information.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
