EMERGENCY PLANNING INSPECTIONS, TESTS, ANALYSES, ANDACCEPTANCE CRITERIA (EP ITAAC) - NEI GENERIC ISSUE COL-10, PROJECT 689The purpose of this letter is to respond to your September 15, 2004, letter, and to address theresolution of various issues associated with the development of emergency planning (EP) inspections, tests, analyses, and acceptance criteria (ITAAC) during the November 9, 2004, public meeting between NRC and NEI.During the November 9 meeting, two of the more difficult EP ITAAC issues were resolved,which dealt with reconciling various timing aspects, and addressed offsite emergency planning(EP) aspects that are outside of the licensee's control. The timing aspects were associated with submission of detailed implementing procedures, and completion of an exercise that would test the integrated response capabilities. The offsite EP aspects dealt with correcting anyoffsite exercise deficiencies. The resulting generic EP ITAAC are reflected in the enclosed Table 13.3-1.Also during the November 9 meeting, NEI questioned whether a new 44 CFR 350 review andapproval by the Federal Emergency Management Agency (FEMA) would be necessary for a new reactor that is constructed on an existing reactor site, whose plans have previously been approved by FEMA under the 44 CFR 350 process. On January 14, 2005, FEMA responded to this question, stating that it would not; so long as the size of the (10-mile) emergency planning zone (EPZ) is not increased, and no significant changes are necessary in State and local EP.The EP ITAAC present a first-of-a-kind example of programmatic ITAAC under 10 CFR Part 52,and reflect the collective efforts of the NRC and FEMA staff, industry and other stakeholderinput, and incorporation of various lessons learned from previous design certification reviews.
They are generic in nature, and would be tailored by each COL applicant to their specific reactor design and EP program requirements. While the EP ITAAC table reflects what we believe to be a reasonable basis for the development of the minimum EP ITAAC in a combined license (COL) application, the acceptability of proposed plant-specific EP ITAAC in a COLapplication will be reviewed on a case-by-case basis, as part of NRC's reasonable assurancedetermination.
