| Description | 10 CFR 50.73, Licensee Event Report System, requires, in part that holders of operating licenses shall submit a Licensee Event Report (LER) within 60 days after discovery of any event such as those described in sections (a)(2)(i)(B), operation prohibited by technical specifications (TS) and (a)(2)(v)(D), a condition that could have prevented the fulfillment a system safety function to mitigate the consequences of an accident. Contrary to this requirement, the licensees discovery of the Unit 1 Shield Building Ventilation System not meeting TS and not being able to fulfill its safety function was not reported within 60 days. The licensee submitted LER 2010- 004-00 on July 16, 2010, exceeding the within 60 day requirement. The inspectors reviewed the issue in accordance with Inspection Manual Chapter 0612 and the NRC Enforcement Manual and determined that traditional enforcement was applicable to the issue because the NRCs regulatory ability was affected. Specifically, the NRC relies on the licensee to identify and report conditions or events meeting the criteria specified in the regulations to perform its regulatory function. The finding was reviewed by NRC management and because the violation was determined to be of very low safety significance, was not repetitive or willful, and was entered into the CAP as condition report 2010-16023, this violation is being treated as a NCV consistent with the NRC Enforcement Policy. |
