nas@nrc.govNRCTODISCUSSDISMISSALOFWORKERWITHPHILADELPHIAVETERANSADMINISTRATIONMEDICALCENTERNuclearRegulatoryCommissionstaffwillmeetwithofficialsofthePhiladelphiaVeteransAdministrationMedicalCenteronMay17todiscussafederalreviewboard'sdecisionregardingthe terminationofaformeremployeeofthefacility.Thepredecisionalenforcementconferencewillbeginat9:30a.m.inthePublicMeetingattheNRC'sRegionIofficeinKingofPrussia,Pa.Itwillbeopentothepublicforobservation.InApril1998,aresearchnurseatthemedicalcenterwasnotifiedthatheremploymentwouldbeterminatedasofMay15,1998.TheworkersubsequentlychallengedthedecisionbeforetheU.S.

MeritSystemsProtectionBoard,allegingtheterminationoccurredinresponsetosafetyconcernsshe hadraised.Inaddition,thenurseassertedsaidshewassubjectedtointolerableworkingconditions priortoherdismissal.OnApril16,1999,anadministrativelawjudgefortheboardissuedaninitialdecisionorderingthehospitaltoreinstatetheworker,withbackpay.NRCstaffhopestogathermoreinformationaboutthecaseatthemeetingonMay17inordertorenderitsowndecisiononthematter.Indeed,thedecisiontoholdapredecisionalenforcementconferencedoesnotmeanthattheNRChasdeterminedaviolationhasoccurredorthatenforcementactionwillbetaken.Rather,the purposeistodiscussapparentviolations,theircausesandsafetysignificance,andtoenablethe licenseetooutlineanyproposedcorrectiveaction.Nodecisionontheapparentviolationswillbemadeatthisconference.ThatdecisionwillbemadebyNRCofficialsatalatertime.
