NRCNEWSU.S.NUCLEARREGULATORYCOMMISSIONOFFICEOFPUBLICAFFAIRS,REGIONI475AllendaleRoadKingofPrussia,PA19406No.I-00-72October20,2000CONTACT:DianeScrenci(610)337-5330/e-mail:dps@nrc.govNeilA.Sheehan(610)337-5331/e-mail:nas@nrc.govNRCPROPOSES$8,800FINEAGAINSTTEMPLEUNIVERSITYHOSPITALTheNuclearRegulatoryCommissionstaffhascitedTempleUniversityHospitalfordiscriminatingagainstatechnicianwhoraisedsafetyconcerns.TheNRChasproposedacivilpenalty of$8,800againstthePhiladelphiamedicalfacility.AnNRCinvestigationdeterminedthatTempleUniversityHospitalmanagementdiscriminatedagainstanuclearmedicinetechnologistin1998.InNovemberofthatyear,thetechnicianinformed hersupervisorofherintenttoresign.However,shewassubsequentlynotpermittedtorescindher resignationbyTemplemanagement,eventhoughshewasstillemployedbythehospitalatthetimeand hadbeentoldbyhersupervisorthattheresignationcouldberescinded.BasedonthefindingsoftheNRC'sOfficeofInvestigationandinformationprovidedbythehospitalduringapredecisionalenforcementconferenceonAugust14,ofthisyear,theNRCstaff determinedthetechnician'spreviousinvolvementinprotectedactivitieswasatleastpartofthereason shewasnotallowedtorescindherresignation.NRCregulationsprohibitalicenseefromdiscriminatingagainstanyemployeeforengagingincertainprotectedactivities,suchasprovidingalicenseewithnuclearsafetyconcernsortestifyingat anyfederalproceedingrelatedtoNRCrequirements.Discriminationincludesdischargeandother actionsthatrelatetocompensation,terms,conditionsorprivilegesofemployment.InaletterforwardingtheNoticeofViolation,NRCRegionIAdministratorHubertJ.Millersaidhewasissuingtheproposedcivilpenaltyto"emphasizetheimportanceofcontinuouslyassuringa workenvironmentthatisfreeofanyharassment,intimidation,ordiscriminationagainstthosewho raisesafetyconcerns."TempleUniversityHospitalhas30daystopaythefineortoprotestit.IfthefineisprotestedandsubsequentlyimposedbytheNRCstaff,thecompanymayrequestahearing.
