NRCNEWSU.S.NUCLEARREGULATORYCOMMISSIONOFFICEOFPUBLICAFFAIRS,REGIONI475AllendaleRoadKingofPrussia,PA19406No.I-01-005February5,2001CONTACT:DianeScrenci,(610)337-5330/e-mail:dps@nrc.govNeilA.Sheehan,(610)337-5331/e-mail:nas@nrc.govNRCTODISCUSSAPPARENTVIOLATIONSWITHPA.CIVILENGINEERINGFIRMNuclearRegulatoryCommissionstaffwillmeetwithrepresentativesofaPennsylvaniacivilengineeringfirmonThursday,February8,todiscussapparentviolationsofagencyrequirements involvingtheuseandcontrolofgaugescontainingradioactivematerial.Thepredecisionalenforcementconferenceisscheduledtobeginat9:30a.m.inthePublicMeetingRoomoftheNRCRegionIofficeinKingofPrussia,Pa.Itwillbeopentothepublic.GilmoreandAssociatesInc.,basedinNewBritain,Pa.,ownssixportablenucleargauges.Thedevicescontaincesium-137andamericium-241andareusedtomeasurethedensityandmoisture contentofsoilandasphalt.Theuseofgaugesisasmallpartofthecompany'sbusiness.DuringanNRCsafetyinspectionconductedonNovember15and16andDecember19,sevenapparentviolationswereidentified,fiveofwhichwererepeatsofviolationsfoundduringtheprevious inspection.Themostsignificantapparentviolationwasafailuretocontrolandmaintainconstant surveillanceofaportablenucleargauge,whichresultedinseveredamagetothedevicewhenitwas runoverbyheavyconstructionequipment.Althoughthegaugewasseverelydamaged,thenuclear materialsremainedintactandnoradiationexposuretopersonneloccurred.ThedecisiontoholdapredecisionalenforcementconferencedoesnotmeantheNRChasdeterminedaviolationhasoccurredorthatenforcementactionwillbetaken.Rather,thepurposeisto discussapparentviolations,theircausesandsafetysignificance;toprovidethelicenseewithan opportunitytopointoutanyerrorsthatmayhavebeenmadeintheNRCinspectionreport;andto enablethelicenseetooutlineitsproposedcorrectiveaction.Nodecisionontheapparentviolationswillbemadeatthisconference.ThatdecisionwillbemadebyNRCofficialsatalatertime.
