ChairmanSmithbeganbyinforming thepartiesthathehadrequested JudgeBlochtojoininthecallbecausetherewasapossibility thatJudgeBlochwouldbeappointed toreplaceChairmanSmithasamemberoftheBoardduetoChairmanSmithsotherresponsibilities.
ChairmanSmithnotedtheabsenceofcounselforParsons&Whittemore andstatedthat,althoughParsons&Whittemore hasnotbeenadmittedasapartytotheproceeding, theBoardisnot,inclinedtomakeanyrulingwhichmightaffectParsons&Whittemore intheeventitisadmittedasapartytotheproceeding withoutfirsthearingfromParsons&Whittemore.
CounselforFPLstatedthatFPLisconcerned withthetimingoftheproceeding, becauseFPL'spresentplanscallforloadingoffuelatSt.LucieUnitNo.2inOctober1982.FPLbelievesthattheCities,becauseofrepresentations whichtheymadeatthetimethattheysoughtlateintervention in

intheproceeding in1976and1977,areprecluded fromobjecting toissuanceofanoperating licenseatthetimewhenthelicenseisotherwise.
ripeforissuancenotwith-standingthependencyofantitrust proceedings withrespecttoSt.LucieUnitNo.2.CounselforFPLdescribed communi-cationsbetweenFPLandtheCitieswh'ichhaveoccurredsub-sequenttoMay27,1981,thedateonwhichCities'otion toEstablish Procedures, etc.wasfiled.CounselforCitieshastakenthepositionindiscussions withFPLthattheCitiesarenotnowprecluded byanyrepresentations orstipulations fromopposingissuanceoftheoperating licenseuntilantitrust proceedings havebeencompleted.
Asaresultofthesediscussions, FPLrequested thattheCitiesnowenterintoastipulation thatissuanceoftheoperating licensewillnotbedelayedduetothependencyofantitrust proceedings.
CounselforFPLstatedthattheCities'esponse hadbeenreadtohimbyMr.Rothoverthetelephone afewminutesbeforethecallbegan.Thediscussion duringtheconference callindicated thattheCitiesarenotnowpreparedtoenterintothestipulation requested byFPLunlessFPLeither(1)stipulates toprocedures whichwillassurethatanin-itialdecisioncanbeissuedbeforetheoperating licenseisissuedandwaivesanyrighttoseekastayofanyreliefimposedbyaninitialdecisionpendingappealofthatdecision, or(2)stipulated thatanoperating licenseissuedbeforeantitrust proceedings arecompleted shallcontain"interim" licenseconditions acceptable totheCities.Mr.Rothindi-cated,however,thatCitieshavenotyetdetermined whethertheywouldagreetounconditional stipulation iftheconditions whichtheyproposeareunacceptable toFPL.CounselforFPLstatedthatFPLwillfileamotionrequesting thattheCitiesbeprecluded fromobjecting toissuanceofanoperating licensenotwithstanding thependencyofantitrust proceedings.
Mr.Rothindicated thattheCitiesmight,intheirresponse, addressprocedures whichcouldbeadoptedtoincreasethelikelihood thatthisproceeding willbecompleted beforeanoperating licenseisotherwise ripeforissuance.
ChairmanSmithdirectedthattheCitiesalsoanticipate thepossibility thatthisproceeding willnotbecompleted at,suchtimeandstateunambiguously theirpositionastowhethertheoperating licensecouldthenissuenotwithstanding thependencyofantitrust proceedings.
Heemphasized theimportance ofthepartiesbeingpreparedtoassumeresponsibility fortheconsequences ofthepositions whichtheytakeonthisquestion.
ChairmanSmithrequested thatthepartiesintheirpleadings concerning thepossibility ofissuinganoperating licensenotwithstanding thependencyofantitrust proceedings addressthequestionoftheBoard'sjurisdiction toaccomplish thisresult.
CounselforFPLindicated that,inlightoftheabsenceofanyagreement onastipulation, FPLwouldpromptlyfileamotionrequesting thatdiscovery resumeandthatanswerstooutstanding interrogatories berequiredwithinthenearfuture.ChairmanSmithstatedthattheBoardfoundthepriorpleadings submitted bytheCitiesconcerning thesettlement proposedbyFPL,theDepartment ofJusticeandtheNRCStafftobevagueandlackinginspecificity astothere-liefwhichtheCitiessought.TheChairmanstatedthattheBoardexpectstheCitiesforthcoming pleadingtocontainanunambiguous statement oftheadditional reliefwhichthe*/Citiesseek,-andhestatedthatanyfurtherpleadingwhichisasvagueasthepriorpleadings maynotbegivenmuchweight.ChairmanSmithaskedcounselfortheCitiesiftheMay27pleadingwasintendedtobeamotionforsummarydisposition undertheNRC'srules.Mr.Rothrepliedintheaffirmative.
