Generating Station, Unit 1) 5 APPLICANT' S RESPONSE '"O PETITION FOR LEAVE TO INTERVENE BY W. MATTHEW PERRENOD Applicant files this response to the petition for leave to intervene in this proceeding filed by W. Matthew Perrenod.

Petitioner's residence appears to be only marginally within the geographic zone of interest. His statement of interest reflects the tenuous nature of his standing:

"I have a direct and personal interest in the health and safety of myself and my family, and in our use and enjoyment of the natural resources within fifty miles of the plant."

Beyond the unacceptably vague statement of interest, the petition plainly fails, in any credible way, to meet that requirement of the Supplementary Notice of Intervention Pro-cedures (44 Fed. Reg. 35062) which specifies that petitioners:

"

...shall state that he failed to file a petition for leave to intervene pursuant to the Board's notices of May 31 and September 11, 1978, because

of the restrictions on permissible contentions contained in those notices..."

The " restrictions" mentioned in the Supplementary Notice were those which limited contentions to matters arising _

out of proposed changes in plant design or arising out of evi-dence or information not available prior to the issuance of ALAB-301 in December 1975.

A careful review of petitioner's sole contention as reflected in paragraph 5 of the petition shows clearly that the contention is not founded on "new" evidence or information.

Petitioner speaks of "incresed [ sic) estimates of costs of construction and operation"; " increased costs of capital financing and reduced availibility [ sic] of the same; and inability of the operator to obtain increases in price rates..." (emphasis added) The entire contention appears founded on relatively recent developments or prognoses of future de' alopments. As such, the contention could have been raised in response to the notices of May 31 and Septem-ber 11, 1978. Accordingly, it is plainly nontimely and un-supported by any discussion of the factors set forth in 10 CFR 2.714(a)(2)(i)-(v).

The contention, by its very terms, casts doubt on the accuracy (or candor) of the statement in the second para-graph of the petition that:

"

...I failed to file for leave to intervene earlier because of restrictions on permissible contentions contained in the Board's notices of May 31 and -

September 11, 1978."

Should the Board determine that petitioner has established a cognizable interest, the circumstances described above require ,

that the petitioner explain in a brief evidentiary hearing (perhaps at the time of the next prehearing conference) the basis for the apparent inconsistency between paragraphs 2 and 5 of the petition.

This petition should be denied.
