UnitedStatesNuclearRegulatoryCommissionOfficeofPublicAffairs,RegionI475AllendaleRoadKingofPrussia,PA19401Phone:610/337-5330Fax:610/337-5241Internet:dps@nrc.govornas@nrc.govI-97-137October20,1997Contact:DianeScrenciFORIMMEDIATERELEASENeilA.SheehanNRC,DEFENSEAGENCYTODISCUSSAPPARENTVIOLATIONATDEPOTTheNuclearRegulatoryCommissionstaffwillmeetwithofficialsoftheU.S.DefenseLogisticsAgencyonWednesday, October22,todiscussanapparentviolationofNRCrequirements attheLetterkennyArmyDepotinChambersburg,Pa.Thepredecisionalenforcementconferencewillbeginat1:30p.m.intheDivisionofNuclearMaterialsSafetyconference roomattheNRCRegion1officeinKingofPrussia,Pa.Itwill beopentothepublicforobservation.DuringaninspectionconductedattheArmydepotinSeptember,NRCstaffidentifiedanapparentfailuretosecure fromunauthorizedremovaloraccess,ormaintainconstant surveillanceof,licensedradioactivematerialsinacontrolled orunrestrictedarea.Theinspectionwasinitiatedafterseven 3-curietritiumsourcesweredeterminedtobemissingfroma storageareaatthedepotinlateAugust.Thesourceswerelater foundattheresidenceofadepotemployee.ThedecisiontoholdapredecisionalenforcementconferencedoesnotmeanthattheNRChasdeterminedaviolation hasoccurredorthatenforcementactionwillbetaken.Rather, thepurposeistodiscussapparentviolations,theircausesand safetysignificance;toprovidethelicenseewithanopportunity topointoutanyerrorsthatmayhavebeenmadeintheNRC inspectionreport;andtoenablethelicenseetooutlineits proposedcorrectiveaction.Nodecisionontheapparentviolationswillbemadeatthisconference.ThatdecisionwillbemadebyNRCofficialsat alatertime.
