FloridaPower&LightCompanySt.LucieUnitNo.2DocketNo.50-389AJunell,1981MEMORANDUMOFCONFERENCECALLAconferencecallwasheldonMonday,Junellat'herequestofFloridaPower&LightCompany(FPL).ChairmanSmith,JudgeLazo,Mr.Roth(counselfortheinterveningcities),Ms.Urban(counselfortheDepartmentofJustice),Mr.VoglerandMs.Hodgdon(counselfortheNRCStaff)andMessrs.BouknightandDym(counselforFPL)participated.JudgeBlochjoinedthecallinprogress.ChairmanSmithbeganbyinformingthepartiesthathehadrequestedJudgeBlochtojoininthecallbecausetherewasapossibilitythatJudgeBlochwouldbeappointedtoreplaceChairmanSmithasamemberoftheBoardduetoChairmanSmithsotherresponsibilities.ChairmanSmithnotedtheabsenceofcounselforParsons&Whittemoreandstatedthat,althoughParsons&Whittemorehasnotbeenadmittedasapartytotheproceeding,theBoardisnot,inclinedtomakeanyrulingwhichmightaffectParsons&WhittemoreintheeventitisadmittedasapartytotheproceedingwithoutfirsthearingfromParsons&Whittemore.CounselforFPLstatedthatFPLisconcernedwiththetimingoftheproceeding,becauseFPL'spresentplanscallforloadingoffuelatSt.LucieUnitNo.2inOctober1982.FPLbelievesthattheCities,becauseofrepresentationswhichtheymadeatthetimethattheysoughtlateinterventionin

intheproceedingin1976and1977,areprecludedfromobjectingtoissuanceofanoperatinglicenseatthetimewhenthelicenseisotherwise.ripeforissuancenotwith-standingthependencyofantitrustproceedingswithrespecttoSt.LucieUnitNo.2.CounselforFPLdescribedcommuni-cationsbetweenFPLandtheCitieswh'ichhaveoccurredsub-sequenttoMay27,1981,thedateonwhichCities'otiontoEstablishProcedures,etc.wasfiled.CounselforCitieshastakenthepositionindiscussionswithFPLthattheCitiesarenotnowprecludedbyanyrepresentationsorstipulationsfromopposingissuanceoftheoperatinglicenseuntilantitrustproceedingshavebeencompleted.Asaresultofthesediscussions,FPLrequestedthattheCitiesnowenterintoastipulationthatissuanceoftheoperatinglicensewillnotbedelayedduetothependencyofantitrustproceedings.CounselforFPLstatedthattheCities'esponsehadbeenreadtohimbyMr.Rothoverthetelephoneafewminutesbeforethecallbegan.ThediscussionduringtheconferencecallindicatedthattheCitiesarenotnowpreparedtoenterintothestipulationrequestedbyFPLunlessFPLeither(1)stipulatestoprocedureswhichwillassurethatanin-itialdecisioncanbeissuedbeforetheoperatinglicenseisissuedandwaivesanyrighttoseekastayofanyreliefimposedbyaninitialdecisionpendingappealofthatdecision,or(2)stipulatedthatanoperatinglicenseissuedbeforeantitrustproceedingsarecompletedshallcontain"interim" licenseconditionsacceptabletotheCities.Mr.Rothindi-cated,however,thatCitieshavenotyetdeterminedwhethertheywouldagreetounconditionalstipulationiftheconditionswhichtheyproposeareunacceptabletoFPL.CounselforFPLstatedthatFPLwillfileamotionrequestingthattheCitiesbeprecludedfromobjectingtoissuanceofanoperatinglicensenotwithstandingthependencyofantitrustproceedings.Mr.RothindicatedthattheCitiesmight,intheirresponse,addressprocedureswhichcouldbeadoptedtoincreasethelikelihoodthatthisproceedingwillbecompletedbeforeanoperatinglicenseisotherwiseripeforissuance.ChairmanSmithdirectedthattheCitiesalsoanticipatethepossibilitythatthisproceedingwillnotbecompletedat,suchtimeandstateunambiguouslytheirpositionastowhethertheoperatinglicensecouldthenissuenotwithstandingthependencyofantitrustproceedings.Heemphasizedtheimportanceofthepartiesbeingpreparedtoassumeresponsibilityfortheconsequencesofthepositionswhichtheytakeonthisquestion.ChairmanSmithrequestedthatthepartiesintheirpleadingsconcerningthepossibilityofissuinganoperatinglicensenotwithstandingthependencyofantitrustproceedingsaddressthequestionoftheBoard'sjurisdictiontoaccomplishthisresult.

CounselforFPLindicatedthat,inlightoftheabsenceofanyagreementonastipulation,FPLwouldpromptlyfileamotionrequestingthatdiscoveryresumeandthatanswerstooutstandinginterrogatoriesberequiredwithinthenearfuture.ChairmanSmithstatedthattheBoardfoundthepriorpleadingssubmittedbytheCitiesconcerningthesettlementproposedbyFPL,theDepartmentofJusticeandtheNRCStafftobevagueandlackinginspecificityastothere-liefwhichtheCitiessought.TheChairmanstatedthattheBoardexpectstheCitiesforthcomingpleadingtocontainanunambiguousstatementoftheadditionalreliefwhichthe*/Citiesseek,-andhestatedthatanyfurtherpleadingwhichisasvagueasthepriorpleadingsmaynotbegivenmuchweight.ChairmanSmithaskedcounselfortheCitiesiftheMay27pleadingwasintendedtobeamotionforsummarydispositionundertheNRC'srules.Mr.Rothrepliedintheaffirmative."/ThisistheunderstandingofcounselforFPL.CounselfortheCities'nderstoodtheBoardtobedirectingtheCitiestobeunambiguousinforthcomingpleadingsaboutwhattheCitiesseekinthosepleadings,anddoesnotunderstandtheCitiesnortobeobligatedtospecifytheultimatereliefwhichtheyseeksuchastheexactmegawattagetheywant.

CounselforFPLsaidthataresponsetoamotionforsummarydisposition,whichappearstobeaddressedtoallissuesinthecaseotherthanrelief,shouldnotberequireduntilfurtherdiscoveryhasbeencompleted,andthatFPLin-tendstofileamotionrequestingthatitnotberequiredatthistimetorespondtotheMay27pleadingasamotionforsummarydisposition.Inclosing,ChairmanSmithagainstatedthedecisionoftheBoardtoreceivefromtheCitiesanunambiguousstatementoftheirpositionandspecificationofthefurther*/reliefsoughtbytheCities.-InaccordancewiththeChairman'sdirections,thismemorandumwaspreparedbycounselforFPLandcirculatedtoallparticipantsintheconferencecallforapprovalbeforefilingwiththeBoard.J.A.Bouknight,Jr."/Seefootnoteonpreviouspage.
