(Allens Creek Nuclear 5 Generating Station, Unit 1) 5 APPLICANT'S RESPONSE TO PETITION FOR LEAVE TO INTERVENE BY CHARLES ANDREW PEREZ Applicant files this response to the petition for leave to intervene filed by Charles Andrew Perez.

The petition is defective in its assertion of interest, being essentially the following:

"I have a direct and personal interest and concern in the health and safety of myself and the many members of my family, and in our use and enjoyment of the natural resources within a fifty (50) mile radius of the plant."

This is an unacceptably vague statement of interest, especially when made by one whose residence is only marginally within the 50 mile geographic zone of interest.

Additionally, petitioner's sole contention is based on his reading of a statement in the PSAR concerning a position taken by Applicant on the structural integrity test of the drywell. The differences in engineering judgment between the Applicant and Staff in this regard have long

been resolved and Applicant has committed to test the drywell at design pressure. (See PSAR Sectior 3.8.3.7). The NRC has indicated its unqualified approval of the Applicant's commitment. (See SER Supplement No. 1, p. 3-4, June 1975 and Supplement No. 2, pp. 3-6, March 1979). Accordingly, the sole issue in the petition is moot and the document is bereft of any clear statement of the subject of the proceeding as to which petitioner seeks intervention. 10 CFR 2.714(a)(2).

The petition should, for the foregoing reasons, be denied.
