In Reference 1, NextEra Energy Seabrook, LLC (NextEra) submitted a written request for approval of enforcement discretion, as discussed verbally between NextEra and the Nuclear Regulatory Committee (NRC) staff on September 23 , 2021. During the call, NextEra verbally requested enforcement discretion pertaining to Technical Specification (TS) 3.7.4, "Service Water System I Ultimate Heat Sink." That request was to allow delaying taking actions specified within the Technical Specifications, and to provide additional time to process an Emergency License Amendment Request (LAR). The period of enforcement discretion requested was five days. In Reference 2, NextEra submitted an Emergency LAR that would modify TS 3.7.4 ACTION b, by extending the Allowed Outage Time (AOT) on a one-time basis for a Service Water (SW) system cooling tower cell from seven days to sixteen days.
Based upon subsequent repair efforts on SW cooling tower fan 5 lB (l-SW-FN-5 lB), a 24-hour endurance run, and declaration of operability prior to the expiration of the 5-day enforcement discretion period, NextEra hereby withdraws emergency LAR 21-02.
