NOTICE OF APPEAL )gQ

'Pursuant to 10 CFR $ 2. 714(a), Petitioners Florida Cities appeal from the June 3, 1981 Order of the Atomic Safety and Licensing Board denying their Petition for Leave to Intervene and Request for Hearing in the above-captioned proceeding. The order was dated June 3, 1981 and docketed and served June 4, 1981.

However, the Order was not served on counsel for Florida Cities and counsel did not have actual notice that such an order had been issued until June 19, 1981. They received a copy of the Order June 22, 1981. Apparently, Florida Cities had been inad-vertently left off the service list.

1 F or>.da Cz.tz.es include the Gainesville Regional Utilities, the Lake Worth Utilities Authority, the Utilities Commission of New Smyrna Beach, the Sebring Utilities Commission, and the Qrs~

Cities of Alachua; Bartow, Fort Meade, Homestead, Key West, 5 Kissimmee, Mount Dora, Newberry, St. Cloud, Starke, and Tallahassee, Florida.

Under these circumstances, counsel for Florida Cities believe that an appeal would be timely served ten days after June 22, 1981. However, in view of the above circumstances, Florida Cities give immediate notice of their intent to appeal the June 3, 1981 Order.

Respectfully submitted, Robert A. Jablon Attorney for Florida Cities June 23, 1981 Law offices of Spiegel S McDiarmid 2600 Virginia Avenue, M. W.
