The U.S. Nuclear Regulatory Commission (NRC) identified an error related to the amount billed to Dominion Virginia Power under Title 10 of the Code of Federal Regulations (10 CFR),
Part 170.11(a)(2). The code states that No application fees, license fees, renewal fees, inspection fees, or special project fees shall be required for: A contested hearing conducted by the NRC on a specific application or the authorizations and conditions of a specific NRC license, certificate, or other authorization, including those involving individual plant security modifications.
Staff from the Office of the Chief Financial Officer (OCFO) has worked with the staff from the Office of New Reactors to identify the billable Cost Activity Codes that were used to charge time spent on contested hearing activities. The staff reviewed and validated charges dating back six years to October 2011, in accordance with National Archives and Records Administration, General Records Schedule 1.1: Financial Management and Reporting Records, Item 010 (Financial transaction records related to procuring goods and services, paying bills, collecting debts, and accounting).
The review determined that $4,236.00 was incorrectly billed for work on contested hearings for North Anna Unit 3 application (docket number 05200017). As a result, the NRC will issue a refund to Dominion Virginia Power in the amount of $4,236.00. Please note that since this error occurred, NRC has implemented internal control measures to prevent a reoccurrence of this type of error.
