Gentlemen:

Based on inspections conducted of your activities on March 3 - 21, 1980, it appears that certain of those activities were in noncompliance with NRC regula-tions and the conditions of your license, DPR-35.

By our letter to you dated July 8, 1980, certain apparent noncompliances were identified in the Notice of Violation attached to that letter and civil penalties were proposed in the Notice of Proposed Imposition of Civil Penalties enclosed with that letter.

In consideration of your response dated August 1,1980, one apparent noncompliance previously identified as Item II.A Ms been withdrawn and another apparent noncompliance has been added as is more specifically set out in the enclosed Appendix A, an Amended Notice of Violation.

A Civil Penalty is proposed in the amount of $4,000 for this addiiional v'iolation as is indicated in the enclosed Appendix B, Notice of Proposed Imposition of Civil Penalty.

We will await your response to the Amended Notice of Violation prior to reaching a final determination on the remaining apparent items of noncompliance identified in the original Notice of Violation.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and the enclosures will be placed in the NRC's Public Document Room.
