e APPENDIX A AMENDED NOTICE OF VIOLATION License No. 50P-1585-4 Docket No. 55-3930 EA-80-38 Based on the results of an NRC inspection conducted during the period of March

3 - 21, 1980, it appears cert 31n of your activities were not conducted in full compliance with'NRC regulations and the conditions of your license, 50P-1585-4.

On July 8, 1980,~a Notice of Violation (Appendix A) was served upon you

-identifying an apparent noncompliance and requiring you to respond.

On August 1, 1980, you responded to that Notice.

Upon consideration of your response, that Notice.of_ Violation is withdrawn.

However, based upon'the information contained in your response and our additional evaluation, it appears that an additional noncompliance occurred, as indicated below.

Senior Operator-License No. 50P-1585-4 states in part that, "In directing the licensed activities of licensed operators and in manipulating the controls of the above facility...the licensee shall observe the operating procedures and other conditions specified in the facility license which.

authorizes operation of the facility..."

Technical Specification 3.7.C.1 requires that secondary containment integrity be maintained whenever irradiated fuel movement is in progress.

Technical Specification 6.8.A states in part:

" Written procedures and

-administrative policies shall be established, implemented and maintained that meet or exceed the requirements and recommendations of-Sections 5.1 and 5.3 of f.NSI N18.7-1972 and Appendix A of USNRC Regulatory Guide 1.33..."'

Pilgrim Nuclear Power Station (PNPS) Procedure 4.3, " Fuel Handling,"

Revision 16 requires that " Fuel movement may. not begin until the 'on-duty' Watch Engineer gives his consent."

Contrary to the above, on March 8, 1980, when on duty as the licensed senior reactor operator on the reactor building refueling floor, you initiated irradiated fuel movement without verifying secondary contain-

-ment integrity conformance to Technical Specifications 3.7.C.1 and without verifying conformance with the requirements of PNPS Procedure 4.'3, Revision 16, in effect on March 8, 1980.

Your noncompliance with the re'quirement of your license was a principal factor in the movement of irradiated' fuel within'the spent fuel pool without secondary containment, being established.

. This Amended Notice of Violation is sent to you. pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10,. Code'of Federal Regulations. 'You are hereby required to submit to this office within 8011210#/

(1) admission or denial

- of' the alleged item of noncompliance;-(2) the reasons for the item of noncom-l pliance if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to-avoid further items of noncompliance; and (5) the date when full compliance wil' be achieved.
