SUMMARY

The U.S. Nuclear Regulatory Commission (NRC) has issued Renewed

Facility Operating License Nos. NPF-87 and NPF-89 to Vistra Operations Company

LLC, for Comanche Peak Nuclear Power Plant, Units 1 and 2, respectively. In addition,

the NRC has prepared a Record of Decision that supports the NRCs decision to issue

Renewed Facility Operating License Nos. NPF-87 and NPF-89.

SUPPLEMENTARY INFORMATION:

I. Discussion

Notice is hereby given that the NRC has issued Renewed Facility Operating

License Nos. NPF-87 and NPF-89 to Vistra Operations Company LLC (Vistra, the

licensee), for Comanche Peak Nuclear Power Plant (CPNPP), Units 1 and 2,

respectively. Vistra is the operator of the facility. Renewed Facility Operating License

Nos. NPF-87 and NPF-89 authorize operation of Unit 1 and Unit 2, respectively, by

Vistra at reactor core power levels not in excess of 3,612 megawatts thermal for each

unit, in accordance with the provisions of the CPNPP, Units 1 and 2, renewed licenses

and technical specifications. Notice is also given that the Record of Decision (ROD) that

2 supports the NRCs decision to issue Renew ed Facility Operating License Nos. NPF-87

and NPF-89 is available in the Availability of Documents table.

As discussed in the ROD and the final supplemental environmental impact

statement (FSEIS) for CPNPP, Units 1 and 2, Supplement 60, to NUREG-1437,

Generic Environmental Impact Statement for License Renewal of Nuclear Plants

Regarding License Renewal of Comanche Peak Nuclear Power Plant, Final Report,

dated April 2024, the NRC staff initially considered 16 alternatives to license renewal.

The NRC staff dismissed 13 alternatives because of technical, resource availability, or

commercial limitations that currently exist and that are likely to continue to exist when

the existing CPNPP, Units 1 and 2, licenses expire, rendering these alternatives not

feasible and commercially viable. This resulted in the three reasonable replacement

power alternatives for indepth-evaluation: (a) a new nuclear (Small Modular Reactor)

generation alternative, (b) a natural gas combined-cycle power plant, and (c) a

combination of natural gas combined-cycle power plant, solar, and demand-side

management. The FSEIS documents the environmental review, including the

determination that the adverse environmental impacts of license renewal for CPNPP,

Units 1 and 2, are not so great that preserving the option of license renewal for energy

planning decisionmakers would be unreasonable. In addition to the NRC staffs

independent environmental review, the FSEIS conclusion is based on (1) the analysis

and findings in NUREG-1437, Generic Environmental Impact Statement for License

Renewal of Nuclear Power Plants, (2) information provided in the environmental report

submitted by Vistra, (3) consultation with Federal, State, local, and Tribal agencies, and

(4) the NRC staffs consideration of public comments.

CPNPP, Units 1 and 2, are four-coolant-loop, pressurized light water reactors

located Somervell County, Texas. The application for the renewed licenses, Comanche

3 Peak Nuclear Power Plant Units 1 and 2 License Renewal Application, dated

October 3, 2022, as supplemented by letters dated April 6, 2023, April 24, 2023, and

January 31, 2024, complies with the standards and requirements of the Atomic Energy

Act of 1954, as amended (the Act), and the NRC s regulations. As required by the Act

and NRC regulations in chapter 1 of title 10 of the Code of Federal Regulations

(10 CFR), the NRC has made appropriate findings, which are set forth in the renewed

licenses.

A notice of the proposed issuance of the renewed licenses and an opportunity for

a hearing was published in the Federal Register on December 1, 2022 (87 FR 73798).

The adjudicatory proceeding before the Atomic Safety and Licensing Board (ASLB) is

terminated by ASLBs Memorandum and Order, which was issued on June 20, 2019

(LBP-23-06).
