Pending before this Licensing Board is an April 24, 2012 hearing request/petition to intervene submitted by petitioner Missouri Coalition for the Environment (MCE). In this 10 C.F.R. Part 54 proceeding, MCE challenges the December 15, 2011 license renewal application submitted by Union Electric Company d/b/a Ameren Missouri for the Callaway Plant, Unit 1, located near Fulton, Missouri. Under the agencys current rules of practice, because MCE filed its reply pleading on May 29, 2012, a Licensing Board ruling on MCEs hearing request is to be issued on or before Friday, July 13, 2012.* See 10 C.F.R. § 2.309(i).
The Board notes that under the terms of a recently adopted, albeit not yet published, change to the agencys rules of practice, a new section 2.309(j)(1) would provide the Board with 45 days from the date of this proceedings June 7, 2012 initial prehearing conference, or until Monday, July 23, 2012, within which to render a decision on the MCE hearing petition.
