• this document in a timely manner pursuant to Section 102(2)(C) of the National Environmental Poll:y Act of 1969 Nevertheless, the Nuclear Regulatory Commission is reminded that, if the proposed undertaking vill affect properties included in or eligible for inclusion in the National Register of Historic Places, it is required by

.), Section 106 of the National Historic Preservation Act of 1966 (16 U.S.C. 470f, as amended, 90 Stat.1320) to afford the Council an opportunity to comment on the f-.,

undertaking prior to the approval of the expenditure of

.y any Federal funds or prior to the issuance of any license.

The " Procedures for the Protection of Historic and

/ ; '- Cultural Properties" (36 CFR Part 800.h) detail the steps an agency is to follow in requesting Council cor 2ent.

- Generally, the Council considers environmental evaluations to be adequate when they contain evidence of compliance with Section 106 of the National Historic Preservation Act, as amended. The environmental documentation must ,, ,

demonstrate that either of the following conditions e

--evidence that the agency has consulted the latest edition of the National Register (Federal Register, February 7, 1978 and its monthly supplements);

--evidence of an effort to ensure the identification of properties eligible for inclusion in the National Register, including evidence of contact with the State Historic Preservation Officer, whose comments should be included in the final environmental statement.
