INTERVENORS RESPONSE TO APPLICANTS MOTION FOR EXTENSION OF TIME TO FILE AFFIDAVITS 0 Intervenor, D. Marrack, submits that this Applicants' request be denied.

It was the tenor of the Applicant at the 12 July Houston Meeting and the basis of Mr. Newman's plea for the Applicant at the 13 August Prehearing Conference in Houston, for an earlier (October 1980) hearing date than January 1981, that the Applicant was. ready for hearing then and.that only the presence of Intervenors and the niceties of NRC Rules and Regulations which was delaying the A'pplicant's permit to build' A.C.H.G.S.

This also was the main basis of Mr. Newman's. letter to u-Mr..Lazo 22 August 1980 about the date of Hearing andjavail-ability of the Board.

Now comes the Applicant with a request for " Extension of Time" in a matter which:

a) They were well aware they were required to comply within 30 days from 13 August 1980 b) No objection was filed as.to why they should not comply c) Offer as an excuse unsubctantiated claims .of
