We are counsel for Applicant Dominion Nuclear Connecticut, Inc. ("Dominion") in the above referenced proceeding. We are in receipt of the letter to the Board dated April 4, 2008 from Lloyd B. Subin, Counsel for the NRC Staff, indicating the Staff's understanding that, under the Commission's ruling in Dominion Nuclear Connecticut, Inc. (Millstone Nuclear Power Station, Un its 1 and 2), CLI-06-4, 63 NRC 32, 38-39 (2006), the Staff's response to Connecticut Coalition Against Millstone and Nancy Burton's Petition to Intervene and Request fo r Hearing ("Petition")
in this proceeding would be due on April 18, 2008. Dominion respectfully requests that, should the Board agree with the Staff's position, Dominion be permitted to also file its response to the Petition on April 18, 2008. Simultaneous filings by Applicant and the Staff would contribute to the orderly administration of this pr oceeding, since any potential replies by Petitioners to the responses by Applicant and the Staff would be due on the same date, April 25, 2008. See 10 C.F.R. § 2.309(h)(2).
