Dear Administrative Judges:

Pursuant to 10 C.F.R. § 2.314(b), please find attached the Notice of Appearance for Lloyd B. Subin, Counsel to the NRC Staff.

Furthermore, the Staff wishes to address its understanding of the time for the filing of the Staffs answer. Pursuant to Dominion Nuclear Connecticut, Inc. (Millstone Nuclear Power Station, Units 1 and 2), CLI-06-4, 63 NRC 32, 38-39 (2006), the Office of the Secretary screens all filings bearing Ms. Burtons signature, and does not accept, docket, nor refer to the Atomic Safety and Licensing Board Panel (ASLBP) without first assuring the filing meets all procedural requirements. The Secretary (SECY) referred the request signed by Ms. Burton the ASLBP on March 24, 2008.1 10 C.F.R. § 2.309(h)(1) states that unless otherwise specified by the Commission or the Board, the NRC Staff may file an answer within twenty-five days after service of the request for hearing. The NRC Staff was not officially served until the SECY referral of March 24, 2008. Moreover, because of the standing Commission order regarding Ms. Burtons filings, the Staff believes that the date for the Staffs answer should be twenty-five days 1

Judge Froehlich April 4, 2008 Judge Kennedy Judge Abramson after the filing was screened and accepted by the Office of the Secretary. Accordingly, absent a Board order or clarification, the Staff believes that its answer may be filed on or before April 18, 2008.
