RE: Draft EA for Rancho Seco License Termination Plan Steve, The amendment approving the LTP documents our approval of the licensee's proposed dose modeling, final status survey process, and DCGLs (or acceptable upper limit on measured radiation) which will demonstrate compliance with 20.1402 dose limits. Therefore the EA associatedwith the LTP is based on the assumption that the licensee will comply with the methodology in theLTP.For the subsequent release of the site the licensee must demonstrate, primarily in their final status survey reports, that they performed the dose measurement is accordance with the agreed upon methodology and that the radiation levels measured, if any, complied with the limits.Since this EA is predicated on the methodology and limits documented in the LTP and the release will not be approved unless the licensee complies with those methodology and limits, this EA bounds the conditions at the time of release.I also-discussed with my environmental reviewer the possibility of you choosing to not comment and that is fine with us if you want.John Hickman>>> "Hsu, Steve (DHS-DFDRS-RHB)" <SHsu@dhs.ca.gov>

06/14/2007 3:05 PM Is NRC ready to issue this draft EA prior to receiving the results of the FSS and the demonstration of compliance with 20.1402 dose criteria?I can see the approval of the LTP based on EA or its subsequent EIS, if necessary.

But, isn't it true that NRC will not issue approval to terminate SMUD's operating license usingthis EA, is it?Could you outline the NRC's process or steps for approval of LTP and subsequent-release of unrestricted release? Thanks!
