Request For Reopening of Public Comments on Entergy's License Renewal

Dear NRC:

In a press release Issued from the NRC, No.07-096, it has been announced that Entergy has submitted NEW INFORMATION (emphasis added) on more than two dozen systems at the Vermont Yankee facility just outside of Brattleboro Vermont. Further, the press release at least Intimates that additional Information is expected In the coming days if not weeks.The press release goes on further to state, that the Issuance of the SER will be delayed for a period of at least two months while the NRC reviews this new, never before disclosed information.

This new information on over two dozen systems Is Information that could provide the citizens of the stakeholder community additional contentions that were not/could not be known until said disclosures were forthcoming by the Entergy Corporation.

In short, it Is Impossible for citizens and local governments to raise contentions on Issues and systems that were DELIBERATELY, EGREGIOUSLY and NEGLIGENTLY hidden from them.It Is therefore only fair, that stakeholders been given a proper and adequate opportunity to A) review this newly provided information on over two dozen systems at the Vermont Yankee facility, and B) have the opportunity too raise any contentions that this newly provided Information might create. It Is therefore respectfully requested, that the NRC's Division of License Renewal announce this newly discovered Information in the Federal Registry, and afford all stakeholders the opportunity to provide comments, and/or file new and/or amended Petitions to Intervene and hearing Requests.Because the NRC is so deceitful in its dealing with host communities, and because I am sure the NRC will claim I do not have standing to file this formal request, I have taken the liberty of putting a copy of this request Into the hands of people who do have standing.

Sure they will take it upon themselves to file similar requests In the very near future on this important regulatory issue. Behalf of The Citizens of Brattleboro Sherwood Martinelli Green Nuclear Butterfly 351 Dyckman Peekskill, New York 10566 914 734 1955 Press Release in Question: August 1, 2007 NRC RECEIVES ADDITIONAL INFORMATION, EXTENDS REVIEW FOR VERMONT YANKEE LICENSE RENEWAL The Nuclear Regulatory Commission staff Is revising Its schedule for issuing a Safety Evaluation Report (SER) for the license renewal application from the Vermont Yankee nuclear power plant, about 5 miles south of Brattleboro, Vt.The NRC staff's Inspections and ongoing review of the application have led plant operator Entergy Nuclear Northeast to add Information on more than two dozen systems to those already covered by a preliminary SER. Because of this late change to the renewal application, NRC staff will not issue a complete SER on Aug. 1 as Initially scheduled.

'This change will add at least two months to the review,' said Jim Dyer, Director of the NRC's Office of Nuclear Reactor Regulation.
