UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION ATOMIC SAFETY AND LICENSING BOARD PANEL Before the Licensing Board:

G. Paul Bollwerk, III, Chair William J. Froehlich Nicholas G. Trikouros In the Matter of Union Electric Company (Callaway Plant, Unit 1)

Docket No. 50-483-LR

ASLBP No. 12-919-06-LR-BD01

July 13, 2012 NOTICE (Notice of Need for More Time)

Pending before this Licensing Board is an April 24, 2012 hearing request/petition to intervene submitted by petitioner Missouri Coa lition for the Environment (MCE). In this 10 C.F.R. Part 54 proceeding, MCE challenges the December 15, 2011 license renewal

application submitted by Union Electric Company d/b/a Ameren Missouri for the Callaway Plant, Unit 1, located near Fulton, Missouri. Under the agency's current rules of practice, because

MCE filed its reply pleading on May 29, 2012, a Licensing Board ruling on MCE's hearing

request is to be issued on or before Friday, July 13, 2012.

  • See 10 C.F.R. § 2.309(i).
  • The Board notes that under the terms of a recently adopted, albeit not yet published, change to the agency's rules of practice, a new section 2.309(j)(1) would provide the Board with 45 days from the date of this proceeding's June 7, 2012 initial prehearing conference, or until

Monday, July 23, 2012, within which to render a decision on the MCE hearing petition. See Memorandum from Stephen G. Burns, NRC General Counsel, to the NRC Commissioners, SECY-12-0004 (Jan. 10, 2012), encl. 1, at 119-20 (draft final rule Federal Register notice)

(ADAMS Accession No. ML12010A065); see also Memorandum from Annette L. Vietti-Cook, NRC Secretary, to Marian Zobler, Acting NRC General Counsel & R.W. Borchardt, NRC

Executive Director for Operations (June 29, 2012) (staff requirements memorandum approving

final rule amending 10 C.F.R. Part 2) (ADAMS Accession No. ML12181A121). Pursuant to section 2.309(i), the Board hereby provides notice that it currently anticipates issuing a decision regarding the MCE hearing request by no later than Wednesday, July 18, 2012.
