ME6643)

Dear Mr. Bannister:

By letter dated June 9, 2011 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML 111610160), Omaha Public Power District (OPPD, the licensee), informed the Nuclear Regulatory Commission (NRC) of its intention to extend the commitment date to submit a license amendment request (LAR) for Fort Calhoun Station, Unit 1 (FCS), to adopt the National Fire Protection Association (NFPA) Standard 805, "Performance-Based Standard for Fire Protection for Light-Water Reactor Electric Generation Plants," 2001 Edition, pursuant to Section 50.48(c) of Title 10 of the Code of Federal Regulations (10 CFR). By letter dated November 20,2008 (ADAMS Accession No. ML08271 0002), the NRC granted OPPD enforcement discretion for its transition to NFPA 805 until June 9, 2011. In its letter dated June 9, 2011, OPPD informed the NRC that it is extending its commitment to submit the LAR to an unspecified date. Furthermore, OPPD requested that enforcement discretion be continued until the Industry Fire PRA [Probabilistic Risk Assessment]

Methods Task Force review has completed the review of its new PRA methods, plus an additional 90 days for review of any impact and incorporation into FCS fire PRA model. During the public meetings on April 14 and May 11, 2011, when staggering of NFPA 805 submittals was discussed, senior NRC managers emphasized that it is the staff's expectation that the licensee's submittal will be sufficiently complete and not rely on supplements.

Therefore, the staff recognizes FCS's need for additional time to integrate the Task Force reviewed methods or conduct a sensitivity analysis of any unreviewed methods. After further review, consistent with Commission direction in SRM-SECY-11-0061, lOA Request to Revise the Interim Enforcement Policy for Fire Protection Issues on 10 CFR 50.48(c) to Allow Licensees to Submit License Amendment Requests in a Staggered Approach (RIN 3150-AG48)," dated June 10,2011 (ADAMS Accession No. ML111610616), the NRC staff may grant an extension of the FCS NFPA 805 enforcement discretion, with adequate justification, until the end of fiscal year 2011 (I.e., September 30, 2011). Therefore, in consideration of the above, OPPD has until September 30, 2011 to submit its NFPA 805 LAR to continue to have uninterrupted enforcement discretion.
